| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 810, Government Code, is amended by |
|---|
| 10 | 10 | | adding Section 810.004 to read as follows: |
|---|
| 11 | 11 | | Sec. 810.004. MUNICIPAL CONTROL OF RETIREMENT SYSTEM |
|---|
| 12 | 12 | | PROVISIONS. (a) In this section: |
|---|
| 13 | 13 | | (1) "Agreement" means a jointly arrived at decision |
|---|
| 14 | 14 | | affecting the plan provisions of a public retirement system and |
|---|
| 15 | 15 | | includes any mutually agreed upon changes made by a public |
|---|
| 16 | 16 | | retirement system, the system's sponsoring municipality, and an |
|---|
| 17 | 17 | | employee group, regardless of whether the agreement is achieved |
|---|
| 18 | 18 | | through collective bargaining, meet and confer arrangements, or any |
|---|
| 19 | 19 | | other procedure applicable to the retirement system under its |
|---|
| 20 | 20 | | enabling statute. |
|---|
| 21 | 21 | | (2) "Public retirement system" has the meaning |
|---|
| 22 | 22 | | assigned by Section 802.001. |
|---|
| 23 | 23 | | (b) This section applies to only the following public |
|---|
| 24 | 24 | | retirement systems: |
|---|
| 25 | 25 | | (1) the City of Austin Employees' Retirement System |
|---|
| 26 | 26 | | under Chapter 451 (S.B. 737), Acts of the 72nd Legislature, Regular |
|---|
| 27 | 27 | | Session, 1991 (Article 6243n, Vernon's Texas Civil Statutes); |
|---|
| 28 | 28 | | (2) the Austin Fire Fighters Relief and Retirement |
|---|
| 29 | 29 | | Fund under Chapter 183 (S.B. 598), Acts of the 64th Legislature, |
|---|
| 30 | 30 | | Regular Session, 1975 (Article 6243e.1, Vernon's Texas Civil |
|---|
| 31 | 31 | | Statutes); |
|---|
| 32 | 32 | | (3) the Austin Police Retirement System under Chapter |
|---|
| 33 | 33 | | 452 (S.B. 738), Acts of the 72nd Legislature, Regular Session, 1991 |

|---|

| 52 | 52 | | (10) the Houston Police Officers' Pension System under |
|---|
| 53 | 53 | | Article 6243g-4, Revised Statutes; and |
|---|
| 54 | 54 | | (11) the San Antonio Fire and Police Pension Fund |
|---|
| 55 | 55 | | under Chapter 824 (S.B. 817), Acts of the 73rd Legislature, Regular |
|---|
| 56 | 56 | | Session, 1993 (Article 6243o, Vernon's Texas Civil Statutes). |

| 57 | 57 | | (c) Except as provided by Subsection (e) of this section and |
|---|
| 58 | 58 | | Sections 66 and 67, Article XVI, Texas Constitution, and |
|---|
| 59 | 59 | | notwithstanding any other law, a municipality that is the |
|---|
| 60 | 60 | | sponsoring authority of a public retirement system may adopt by |
|---|
| 61 | 61 | | ordinance or resolution, as applicable, provisions that supplement |
|---|
| 62 | 62 | | or supersede the operative provisions of the public retirement |
|---|
| 63 | 63 | | system's statute, including any provision relating to the benefits, |
|---|
| 64 | 64 | | participation and eligibility requirements, funding source or |
|---|
| 65 | 65 | | amount, and administration of the system. |
|---|
| 66 | 66 | | (d) Except as provided by Subsection (e), to the extent of a |
|---|
| 67 | 67 | | conflict between a statute adopted before the effective date of the |
|---|
| 68 | 68 | | Act enacting this section that applies to a public retirement |
|---|
| 69 | 69 | | system described by Subsection (b) and a municipal ordinance or |
|---|
| 70 | 70 | | resolution adopted by the governing body of the sponsoring |
|---|
| 71 | 71 | | municipality of that retirement system under this section, the |
|---|
| 72 | 72 | | municipal ordinance or resolution prevails. |
|---|
| 73 | 73 | | (e) An agreement entered into before September 1, 2017, |
|---|
| 74 | 74 | | remains in effect until the earlier of: |
|---|
| 75 | 75 | | (1) the expiration date provided by the agreement; or |
|---|
| 76 | 76 | | (2) August 31, 2027. |
|---|
| 77 | 77 | | SECTION 2. This Act takes effect September 1, 2017. |
