66 AN ACT
77 relating to transparency in the rate-setting processes for the
88 Medicaid managed care and child health plan programs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 533, Government Code, is
1111 amended by adding Section 533.01314 to read as follows:
1212 Sec. 533.01314. TRANSPARENCY OF PREMIUM PAYMENT
1313 RATE-SETTING PROCESS FOR MEDICAID MANAGED CARE PROGRAM. (a) The
1414 commission shall ensure the transparency of the premium payment
1515 rate-setting process for the Medicaid managed care program by
1616 publishing actuarial reports:
1717 (1) in a format that allows for tracing data and
1818 formulas across attachments, exhibits, and examples; and
1919 (2) that clearly identify and describe:
2020 (A) the methodology by which the executive
2121 commissioner set the payment rates;
2222 (B) the data sources used;
2323 (C) the components of the process that are
2424 assumptions and how the assumptions are developed;
2525 (D) multipliers and factors used throughout the
2626 reports, including the source and purpose of the multipliers and
2727 factors; and
2828 (E) the methodology by which the executive
2929 commissioner determined that the rates are actuarially sound for
3030 the populations covered and the services provided.
3131 (b) Notwithstanding Subsection (a), the commission is not
3232 required to publish particular information in an actuarial report
3333 if the commission determines the information is proprietary.
3434 SECTION 2. Subchapter B, Chapter 62, Health and Safety
3535 Code, is amended by adding Section 62.061 to read as follows:
3636 Sec. 62.061. TRANSPARENCY OF PREMIUM PAYMENT RATE-SETTING
3737 PROCESS. (a) The commission shall ensure the transparency of the
3838 premium payment rate-setting process for the child health plan
3939 program by publishing actuarial reports:
4040 (1) in a format that allows for tracing data and
4141 formulas across attachments, exhibits, and examples; and
4242 (2) that clearly identify and describe:
4343 (A) the methodology by which the executive
4444 commissioner set the payment rates;
4545 (B) the data sources used;
4646 (C) the components of the process that are
4747 assumptions and how the assumptions are developed;
4848 (D) multipliers and factors used throughout the
4949 reports, including the source and purpose of the multipliers and
5050 factors; and
5151 (E) the methodology by which the executive
5252 commissioner determined that the rates are actuarially sound for
5353 the populations covered and the services provided.
5454 (b) Notwithstanding Subsection (a), the commission is not
5555 required to publish particular information in an actuarial report
5656 if the commission determines the information is proprietary.
5757 SECTION 3. If before implementing any provision of this Act
5858 a state agency determines that a waiver or authorization from a
5959 federal agency is necessary for implementation of that provision,
6060 the agency affected by the provision shall request the waiver or
6161 authorization and may delay implementing that provision until the
6262 waiver or authorization is granted.
6363 SECTION 4. This Act takes effect September 1, 2017.
