66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the consideration of ownership interests of certain
99 persons with disabilities in determining whether a business is a
1010 historically underutilized business for purposes of state
1111 contracting.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 2161.001(3), Government Code, is amended
1414 to read as follows:
1515 (3) "Economically disadvantaged person" means a
1616 person who:
1717 (A) is economically disadvantaged because of the
1818 person's identification as a member of a certain group, including:
1919 (i) Black Americans;
2020 (ii) Hispanic Americans;
2121 (iii) women;
2222 (iv) Asian Pacific Americans;
2323 (v) Native Americans; [and]
2424 (vi) veterans as defined by 38 U.S.C.
2525 Section 101(2) who have suffered at least a 20 percent
2626 service-connected disability as defined by 38 U.S.C. Section
2727 101(16); and
2828 (vii) persons with a disability as defined
2929 by 42 U.S.C. Section 12102; and
3030 (B) has suffered the effects of discriminatory
3131 practices or other similar insidious circumstances over which the
3232 person has no control.
3333 SECTION 2. Section 2161.002, Government Code, is amended by
3434 adding Subsection (e) to read as follows:
3535 (e) The comptroller shall adopt rules to provide goals for
3636 increasing the contract awards for the purchase of goods or
3737 services by the comptroller and other state agencies to businesses
3838 that qualify as historically underutilized businesses because the
3939 businesses are owned or owned, operated, and controlled, as
4040 applicable, wholly or partly by one or more persons with a
4141 disability as defined by 42 U.S.C. Section 12102. The goals
4242 established under this subsection are in addition to the goals
4343 established under Subsections (c) and (d), and the goals
4444 established under Subsections (c) and (d) may not be reduced as a
4545 result of the establishment of goals under this subsection.
4646 SECTION 3. Section 2161.061, Government Code, is amended by
4747 adding Subsection (f) to read as follows:
4848 (f) To be certified by the comptroller as a historically
4949 underutilized business, a business owned by one or more persons who
5050 qualify as economically disadvantaged solely based on being a
5151 person with a disability as defined by 42 U.S.C. Section 12102 must
5252 submit to the comptroller an affidavit from the physician of each
5353 owner claiming a disability verifying that owner's disability.
5454 SECTION 4. Section 2161.125, Government Code, is amended to
5555 read as follows:
5656 Sec. 2161.125. CATEGORIZATION OF HISTORICALLY
5757 UNDERUTILIZED BUSINESSES. The comptroller, in cooperation with
5858 each state agency reporting under this subchapter, shall categorize
5959 each historically underutilized business included in a report under
6060 this subchapter by sex, race, and ethnicity and by whether the
6161 business qualifies as a historically underutilized business
6262 because it is owned or owned, operated, and controlled, as
6363 applicable, wholly or partly by one or more persons with a
6464 disability as defined by 42 U.S.C. Section 12102 or one or more
6565 veterans as defined by 38 U.S.C. Section 101(2) who have suffered at
6666 least a 20 percent service-connected disability as defined by 38
6767 U.S.C. Section 101(16).
6868 SECTION 5. This Act takes effect September 1, 2017.
