88 AN ACT
99 relating to the exclusion of certain resources in determining
1010 eligibility for the supplemental nutrition assistance program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1313 is amended by adding Section 33.021 to read as follows:
1414 Sec. 33.021. EXCLUSION OF CERTAIN RESOURCES IN DETERMINING
1515 SNAP ELIGIBILITY. In determining the eligibility of an applicant
1616 for or recertifying the eligibility of a recipient of supplemental
1717 nutrition assistance benefits, the commission may not consider as
1818 resources the value of a motor vehicle in which the applicant or
1919 recipient or a member of the applicant's or recipient's household
2020 has an ownership interest up to:
2121 (1) $25,000 for the first motor vehicle; and
2222 (2) $25,000 for one additional vehicle.
2323 SECTION 2. The change in law made by this Act applies to an
2424 initial determination or recertification of eligibility of a person
2525 for the supplemental nutrition assistance program under Chapter 33,
2626 Human Resources Code, that is made on or after the effective date of
2727 this Act.
2828 SECTION 3. If before implementing any provision of this Act
2929 a state agency determines that a waiver or authorization from a
3030 federal agency is necessary for implementation of that provision,
3131 the agency affected by the provision shall request the waiver or
3232 authorization and may delay implementing that provision until the
3333 waiver or authorization is granted.
3434 SECTION 4. This Act takes effect September 1, 2017.
