88 AN ACT
99 relating to the confinement in a county jail of a person pending a
1010 transfer to the Texas Department of Criminal Justice and to the
1111 reimbursement of certain costs of confinement.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 493, Government Code, is amended by
1414 adding Section 493.032 to read as follows:
1515 Sec. 493.032. TRANSPORTATION PLAN FOR CERTAIN INMATES. The
1616 department shall develop and implement a plan to effectively and
1717 efficiently take custody of and transport from a county jail an
1818 inmate described by Section 499.121(c) or a person described by
1919 Section 508.281(a) not later than the fifth day after the date on
2020 which all processing required for transferring the inmate or person
2121 has been completed.
2222 SECTION 2. Subchapter F, Chapter 499, Government Code, is
2323 amended by adding Section 499.1215 to read as follows:
2424 Sec. 499.1215. REIMBURSEMENT TO COUNTIES. (a) A county is
2525 entitled to reimbursement from the department for the cost of
2626 confining an inmate described by Section 499.121(c) in a county
2727 jail at a rate of $45 for each day the inmate remains confined
2828 beginning on the sixth day after the date on which all processing
2929 required for transfer has been completed.
3030 (b) A county judge may request reimbursement by submitting
3131 to the comptroller a statement of the amount for which the county is
3232 entitled to reimbursement under Subsection (a). On receipt of a
3333 statement from a county under this subsection, the comptroller
3434 shall reimburse the county in the amount requested from funds
3535 appropriated to the department.
3636 SECTION 3. Subchapter I, Chapter 508, Government Code, is
3737 amended by adding Section 508.285 to read as follows:
3838 Sec. 508.285. REIMBURSEMENT TO COUNTIES. (a) A county is
3939 entitled to reimbursement from the department for the cost of
4040 confining a person described by Section 508.281(a) in a county jail
4141 at a rate of $45 for each day the person remains confined beginning
4242 on the sixth day after the date on which the county's processing
4343 related to the transfer of the person to the department has been
4444 completed if the person is confined after an ineligible release or
4545 only on a charge that the person has committed an administrative
4646 violation of release.
4747 (b) A county judge may request reimbursement by submitting
4848 to the comptroller a statement of the amount for which the county is
4949 entitled to reimbursement under Subsection (a). On receipt of a
5050 statement from a county under this subsection, the comptroller
5151 shall reimburse the county in the amount requested from funds
5252 appropriated to the department.
5353 SECTION 4. As soon as practicable after the effective date
5454 of this Act, the Texas Department of Criminal Justice shall develop
5555 and implement the plan required by Section 493.032, Government
5656 Code, as added by this Act.
5757 SECTION 5. Section 499.1215, Government Code, as added by
5858 this Act, applies only to the reimbursement of a county for the cost
5959 of confinement of an inmate described by Section 499.1215(a) that
6060 occurs on or after September 1, 2019, regardless of whether all
6161 processing required for transfer of the inmate to the Texas
6262 Department of Criminal Justice is completed before, on, or after
6363 September 1, 2019.
6464 SECTION 6. Section 508.285, Government Code, as added by
6565 this Act, applies only to a person who is arrested on or after
6666 September 1, 2019. A person arrested before September 1, 2019, is
6767 governed by the law in effect immediately before the effective date
6868 of this Act, and the former law is continued in effect for that
6969 purpose.
7070 SECTION 7. This Act takes effect September 1, 2017.
