| 10 | 10 | | transfer to the Texas Department of Criminal Justice and to the |
|---|
| 11 | 11 | | reimbursement of certain costs of confinement. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Chapter 493, Government Code, is amended by |
|---|
| 14 | 14 | | adding Section 493.032 to read as follows: |
|---|
| 15 | 15 | | Sec. 493.032. TRANSPORTATION PLAN FOR CERTAIN INMATES. The |
|---|
| 16 | 16 | | department shall develop and implement a plan to effectively and |
|---|
| 17 | 17 | | efficiently take custody of and transport from a county jail an |
|---|
| 18 | 18 | | inmate described by Section 499.121(c) or a person described by |
|---|
| 19 | 19 | | Section 508.281(a) not later than the fifth day after the date on |
|---|
| 20 | 20 | | which all processing required for transferring the inmate or person |
|---|
| 21 | 21 | | has been completed. |
|---|
| 22 | 22 | | SECTION 2. Subchapter F, Chapter 499, Government Code, is |
|---|
| 23 | 23 | | amended by adding Section 499.1215 to read as follows: |
|---|
| 24 | 24 | | Sec. 499.1215. REIMBURSEMENT TO COUNTIES. (a) A county is |
|---|
| 25 | 25 | | entitled to reimbursement from the department for the cost of |
|---|
| 26 | 26 | | confining an inmate described by Section 499.121(c) in a county |
|---|
| 27 | 27 | | jail at a rate of $45 for each day the inmate remains confined |
|---|
| 28 | 28 | | beginning on the sixth day after the date on which all processing |
|---|
| 29 | 29 | | required for transfer has been completed. |
|---|
| 30 | 30 | | (b) A county judge may request reimbursement by submitting |
|---|
| 31 | 31 | | to the comptroller a statement of the amount for which the county is |
|---|
| 32 | 32 | | entitled to reimbursement under Subsection (a). On receipt of a |
|---|
| 33 | 33 | | statement from a county under this subsection, the comptroller |
|---|
| 34 | 34 | | shall reimburse the county in the amount requested from funds |
|---|
| 35 | 35 | | appropriated to the department. |
|---|
| 36 | 36 | | SECTION 3. Subchapter I, Chapter 508, Government Code, is |
|---|
| 37 | 37 | | amended by adding Section 508.285 to read as follows: |
|---|
| 38 | 38 | | Sec. 508.285. REIMBURSEMENT TO COUNTIES. (a) A county is |
|---|
| 39 | 39 | | entitled to reimbursement from the department for the cost of |
|---|
| 40 | 40 | | confining a person described by Section 508.281(a) in a county jail |
|---|
| 41 | 41 | | at a rate of $45 for each day the person remains confined beginning |
|---|
| 42 | 42 | | on the sixth day after the date on which the county's processing |
|---|
| 43 | 43 | | related to the transfer of the person to the department has been |
|---|
| 44 | 44 | | completed if the person is confined after an ineligible release or |
|---|
| 45 | 45 | | only on a charge that the person has committed an administrative |
|---|
| 46 | 46 | | violation of release. |
|---|
| 47 | 47 | | (b) A county judge may request reimbursement by submitting |
|---|
| 48 | 48 | | to the comptroller a statement of the amount for which the county is |
|---|
| 49 | 49 | | entitled to reimbursement under Subsection (a). On receipt of a |
|---|
| 50 | 50 | | statement from a county under this subsection, the comptroller |
|---|
| 51 | 51 | | shall reimburse the county in the amount requested from funds |
|---|
| 52 | 52 | | appropriated to the department. |
|---|
| 53 | 53 | | SECTION 4. As soon as practicable after the effective date |
|---|
| 54 | 54 | | of this Act, the Texas Department of Criminal Justice shall develop |
|---|
| 55 | 55 | | and implement the plan required by Section 493.032, Government |
|---|
| 56 | 56 | | Code, as added by this Act. |
|---|
| 57 | 57 | | SECTION 5. Section 499.1215, Government Code, as added by |
|---|
| 58 | 58 | | this Act, applies only to the reimbursement of a county for the cost |
|---|
| 59 | 59 | | of confinement of an inmate described by Section 499.1215(a) that |
|---|
| 60 | 60 | | occurs on or after September 1, 2019, regardless of whether all |
|---|
| 61 | 61 | | processing required for transfer of the inmate to the Texas |
|---|
| 62 | 62 | | Department of Criminal Justice is completed before, on, or after |
|---|
| 63 | 63 | | September 1, 2019. |
|---|
| 64 | 64 | | SECTION 6. Section 508.285, Government Code, as added by |
|---|
| 65 | 65 | | this Act, applies only to a person who is arrested on or after |
|---|
| 66 | 66 | | September 1, 2019. A person arrested before September 1, 2019, is |
|---|
| 67 | 67 | | governed by the law in effect immediately before the effective date |
|---|
| 68 | 68 | | of this Act, and the former law is continued in effect for that |
|---|
| 69 | 69 | | purpose. |
|---|
| 70 | 70 | | SECTION 7. This Act takes effect September 1, 2017. |
