104 AN ACT
115 relating to the enforcement of commercial motor vehicle safety
126 standards in certain municipalities.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 644.101(b), Transportation Code, as
159 amended by Chapters 278 (H.B. 716) and 1130 (S.B. 58), Acts of the
1610 84th Legislature, Regular Session, 2015, is reenacted and amended
1711 to read as follows:
1812 (b) A police officer of any of the following municipalities
1913 is eligible to apply for certification under this section:
2014 (1) a municipality with a population of 50,000 or
2115 more;
2216 (2) a municipality with a population of 25,000 or more
2317 any part of which is located in a county with a population of
2418 500,000 or more;
2519 (3) a municipality with a population of less than
2620 25,000:
2721 (A) any part of which is located in a county with
2822 a population of 3.3 million; and
2923 (B) that contains or is adjacent to an
3024 international port;
3125 (4) a municipality with a population of at least
3226 34,000 that is located in a county that borders two or more states;
3327 (5) a municipality any part of which is located in a
3428 county bordering the United Mexican States;
3529 (6) a municipality with a population of less than
3630 5,000 that is located:
3731 (A) adjacent to a bay connected to the Gulf of
3832 Mexico; and
3933 (B) in a county adjacent to a county with a
4034 population greater than 3.3 million;
4135 (7) a municipality that is located:
4236 (A) within 25 miles of an international port; and
4337 (B) in a county that does not contain a highway
4438 that is part of the national system of interstate and defense
4539 highways and is adjacent to a county with a population greater than
4640 3.3 million;
4741 (8) a municipality with a population of less than
4842 8,500 that:
4943 (A) is the county seat; and
5044 (B) contains a highway that is part of the
5145 national system of interstate and defense highways; [or]
5246 (9) a municipality located in a county with a
5347 population between 60,000 and 66,000 adjacent to a bay connected to
5448 the Gulf of Mexico;
5549 (10) [(9)] a municipality with a population of more
5650 than 40,000 and less than 50,000 that is located in a county with a
5751 population of more than 285,000 and less than 300,000 that borders
5852 the Gulf of Mexico; or
5953 (11) a municipality with a population of more than
6054 3,000 and less than 10,000 that:
6155 (A) contains a highway that is part of the
6256 national system of interstate and defense highways; and
6357 (B) is located in a county with a population
6458 between 150,000 and 155,000.
6559 SECTION 2. To the extent of any conflict, this Act prevails
6660 over another Act of the 85th Legislature, Regular Session, 2017,
6761 relating to nonsubstantive additions to and corrections in enacted
6862 codes.
6963 SECTION 3. This Act takes effect September 1, 2017.
