10	4		AN ACT
11	5		relating to the enforcement of commercial motor vehicle safety
12	6		standards in certain municipalities.
13	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	8		SECTION 1. Section 644.101(b), Transportation Code, as
15	9		amended by Chapters 278 (H.B. 716) and 1130 (S.B. 58), Acts of the
16	10		84th Legislature, Regular Session, 2015, is reenacted and amended
17	11		to read as follows:
18	12		(b) A police officer of any of the following municipalities
19	13		is eligible to apply for certification under this section:
20	14		(1) a municipality with a population of 50,000 or
21	15		more;
22	16		(2) a municipality with a population of 25,000 or more
23	17		any part of which is located in a county with a population of
24	18		500,000 or more;
25	19		(3) a municipality with a population of less than
26	20		25,000:
27	21		(A) any part of which is located in a county with
28	22		a population of 3.3 million; and
29	23		(B) that contains or is adjacent to an
30	24		international port;
31	25		(4) a municipality with a population of at least
32	26		34,000 that is located in a county that borders two or more states;
33	27		(5) a municipality any part of which is located in a
34	28		county bordering the United Mexican States;
35	29		(6) a municipality with a population of less than
36	30		5,000 that is located:
37	31		(A) adjacent to a bay connected to the Gulf of
38	32		Mexico; and
39	33		(B) in a county adjacent to a county with a
40	34		population greater than 3.3 million;
41	35		(7) a municipality that is located:
42	36		(A) within 25 miles of an international port; and
43	37		(B) in a county that does not contain a highway
44	38		that is part of the national system of interstate and defense
45	39		highways and is adjacent to a county with a population greater than
46	40		3.3 million;
47	41		(8) a municipality with a population of less than
48	42		8,500 that:
49	43		(A) is the county seat; and
50	44		(B) contains a highway that is part of the
51	45		national system of interstate and defense highways; [or]
52	46		(9) a municipality located in a county with a
53	47		population between 60,000 and 66,000 adjacent to a bay connected to
54	48		the Gulf of Mexico;
55	49		(10) [(9)] a municipality with a population of more
56	50		than 40,000 and less than 50,000 that is located in a county with a
57	51		population of more than 285,000 and less than 300,000 that borders
58	52		the Gulf of Mexico; or
59	53		(11) a municipality with a population of more than
60	54		3,000 and less than 10,000 that:
61	55		(A) contains a highway that is part of the
62	56		national system of interstate and defense highways; and
63	57		(B) is located in a county with a population
64	58		between 150,000 and 155,000.
65	59		SECTION 2. To the extent of any conflict, this Act prevails
66	60		over another Act of the 85th Legislature, Regular Session, 2017,
67	61		relating to nonsubstantive additions to and corrections in enacted
68	62		codes.
69	63		SECTION 3. This Act takes effect September 1, 2017.
