115 relating to energy savings performance contracts.
126 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
137 SECTION 1. Sections 44.901(a) and (f-1), Education Code,
148 are amended to read as follows:
159 (a) In this section, "energy savings performance contract"
1610 has the meaning assigned by Section 302.001, Local Government Code
1711 [means a contract for energy or water conservation measures to
1812 reduce energy or water consumption or operating costs of new or
1913 existing school facilities in which the estimated savings in
2014 utility costs resulting from the measures is guaranteed to offset
2115 the cost of the measures over a specified period. The term includes
2216 a contract for the installation or implementation of:
2317 [(1) insulation of a building structure and systems
2418 within the building;
2519 [(2) storm windows or doors, caulking or
2620 weatherstripping, multiglazed windows or doors, heat absorbing or
2721 heat reflective glazed and coated window or door systems, or other
2822 window or door system modifications that reduce energy consumption;
2923 [(3) automatic energy control systems, including
3024 computer software and technical data licenses;
3125 [(4) heating, ventilating, or air-conditioning system
3226 modifications or replacements that reduce energy or water
3327 consumption;
3428 [(5) lighting fixtures that increase energy
3529 efficiency;
3630 [(6) energy recovery systems;
3731 [(7) electric systems improvements;
3832 [(8) water-conserving fixtures, appliances, and
3933 equipment or the substitution of non-water-using fixtures,
4034 appliances, and equipment;
4135 [(9) water-conserving landscape irrigation equipment;
4236 [(10) landscaping measures that reduce watering
4337 demands and capture and hold applied water and rainfall, including:
4438 [(A) landscape contouring, including the use of
4539 berms, swales, and terraces; and
4640 [(B) the use of soil amendments that increase the
4741 water-holding capacity of the soil, including compost;
4842 [(11) rainwater harvesting equipment and equipment to
4943 make use of water collected as part of a storm-water system
5044 installed for water quality control;
5145 [(12) equipment for recycling or reuse of water
5246 originating on the premises or from other sources, including
5347 treated municipal effluent;
5448 [(13) equipment needed to capture water from
5549 nonconventional, alternate sources, including air conditioning
5650 condensate or graywater, for nonpotable uses;
5751 [(14) metering equipment needed to segregate water use
5852 in order to identify water conservation opportunities or verify
5953 water savings; or
6054 [(15) other energy or water conservation-related
6155 improvements or equipment, including improvements or equipment
6256 relating to renewable energy or nonconventional water sources or
6357 water reuse].
6458 (f-1) Notwithstanding other law, the board may use any
6559 available money[, other than money borrowed from this state,] to
6660 pay the provider of the energy or water conservation measures under
6761 this section, and the board is not required to pay for such costs
6862 solely out of the savings realized by the school district under an
6963 energy savings performance contract. The board may contract with
7064 the provider to perform work that is related to, connected with, or
7165 otherwise ancillary to the measures identified in the scope of an
7266 energy savings performance contract.
7367 SECTION 2. Sections 51.927(a) and (g-1), Education Code,
7468 are amended to read as follows:
7569 (a) In this section, "energy savings performance contract"
7670 has the meaning assigned by Section 302.001, Local Government Code
7771 [means a contract for energy or water conservation measures to
7872 reduce energy or water consumption or operating costs of new or
7973 existing institutional facilities in which the estimated savings in
8074 utility costs resulting from the measures is guaranteed to offset
8175 the cost of the measures over a specified period. The term includes
8276 a contract for the installation or implementation of:
8377 [(1) insulation of a building structure and systems
8478 within a building;
8579 [(2) storm windows or doors, caulking or weather
8680 stripping, multiglazed windows or doors, heat-absorbing or
8781 heat-reflective glazed and coated window or door systems, or other
8882 window or door system modifications that reduce energy consumption;
8983 [(3) automatic energy control systems, including
9084 computer software and technical data licenses;
9185 [(4) heating, ventilating, or air conditioning system
9286 modifications or replacements that reduce energy or water
9387 consumption;
9488 [(5) lighting fixtures that increase energy
9589 efficiency;
9690 [(6) energy recovery systems;
9791 [(7) electric systems improvements;
9892 [(8) water-conserving fixtures, appliances, and
9993 equipment or the substitution of non-water-using fixtures,
10094 appliances, and equipment;
10195 [(9) water-conserving landscape irrigation equipment;
10296 [(10) landscaping measures that reduce watering
10397 demands and capture and hold applied water and rainfall, including:
10498 [(A) landscape contouring, including the use of
10599 berms, swales, and terraces; and
106100 [(B) the use of soil amendments that increase the
107101 water-holding capacity of the soil, including compost;
108102 [(11) rainwater harvesting equipment and equipment to
109103 make use of water collected as part of a storm-water system
110104 installed for water quality control;
111105 [(12) equipment for recycling or reuse of water
112106 originating on the premises or from other sources, including
113107 treated municipal effluent;
114108 [(13) equipment needed to capture water from
115109 nonconventional, alternate sources, including air conditioning
116110 condensate or graywater, for nonpotable uses;

120114 [(15) other energy or water conservation-related
121115 improvements or equipment, including improvements or equipment
122116 related to renewable energy or nonconventional water sources or
123117 water reuse].
124118 (g-1) Notwithstanding other law, the board may use any
125119 available money[, other than money borrowed from this state,] to
126120 pay the provider of the energy or water conservation measures under
127121 this section, and the board is not required to pay for such costs
128122 solely out of the savings realized by the institution of higher
129123 education under an energy savings performance contract. The board
130124 may contract with the provider to perform work that is related to,
131125 connected with, or otherwise ancillary to the measures identified
132126 in the scope of an energy savings performance contract.
133127 SECTION 3. Sections 2166.406(a) and (f-1), Government Code,
134128 are amended to read as follows:
135129 (a) In this section, "energy savings performance contract"
136130 has the meaning assigned by Section 302.001, Local Government Code
137131 [means a contract for energy or water conservation measures to
138132 reduce energy or water consumption or operating costs of new or
139133 existing governmental facilities in which the estimated savings in

182176 related to renewable energy or nonconventional water sources or
183177 water reuse].
184178 (f-1) Notwithstanding other law, the state agency may use
185179 any available money[, other than money borrowed from this state,]
186180 to pay the provider of the energy or water conservation measures
187181 under this section, and the state agency is not required to pay for
188182 such costs solely out of the savings realized by the state agency
189183 under an energy savings performance contract. The state agency may
190184 contract with the provider to perform work that is related to,
191185 connected with, or otherwise ancillary to the measures identified
192186 in the scope of an energy savings performance contract.
193187 SECTION 4. Sections 302.001(1), (3), and (4), Local
194188 Government Code, are amended to read as follows:
195189 (1) "Baseline" means a calculation or set of
196190 calculations in an energy savings performance contract that:
197191 (A) may be based on:
198192 (i) historical costs, revenues, accuracy,
199193 or related components; or
200194 (ii) avoided anticipated costs; and
201195 (B) may be used for determining:
202196 (i) [(A)] the costs for energy or water
203197 usage [by a local government] and related net operating costs;
204198 (ii) [(B)] the billable revenues from
205199 providing energy, water, or other utilities to users; or
206200 (iii) [(C)] the efficiency or accuracy of
207201 metering or related equipment, systems, or processes or procedures.
208202 (3) "Energy savings" means an estimated reduction in
209203 net fuel costs, energy costs, water costs, stormwater fees, or
210204 other utility costs, or related net operating costs, including
211205 costs for anticipated equipment replacement and repair, from or as
212206 compared to an established baseline of those costs. The term does
213207 not include an estimated reduction due to a decrease in energy rates
214208 that is not derived from increased conservation or reduced usage.
215209 (4) "Energy savings performance contract" means a
216210 contract with [between a local government and] a provider for
217211 energy or water conservation or usage measures in which the
218212 estimated energy savings, utility cost savings, increase in
219213 billable revenues, or increase in meter accuracy resulting from the
220214 measures is subject to guarantee to offset the cost of the energy or
221215 water conservation or usage measures over a specified period. The
222216 term includes a contract related to the pilot program described by
223217 Subdivision (9-a) and a contract for the installation or
224218 implementation of the following in new or existing facilities,
225219 including all causally connected work:
226220 (A) insulation of a building structure and
227221 systems within the building;
228222 (B) storm windows or doors, caulking or weather
229223 stripping, multiglazed windows or doors, heat-absorbing or
230224 heat-reflective glazed and coated window or door systems, or other
231225 window or door system modifications that reduce energy consumption;
232226 (C) automatic energy control systems, including
233227 computer software and technical data licenses;
234228 (D) heating, ventilating, or air-conditioning
235229 system modifications or replacements that reduce energy or water
236230 consumption;
237231 (E) lighting fixtures that increase energy
238232 efficiency;
239233 (F) energy recovery systems;
240234 (G) electric systems improvements;
241235 (H) water-conserving fixtures, appliances, and
242236 equipment or the substitution of non-water-using fixtures,
243237 appliances, and equipment;
244238 (I) water-conserving landscape irrigation
245239 equipment;
246240 (J) landscaping measures that reduce watering
247241 demands and capture and hold applied water and rainfall, including:
248242 (i) landscape contouring, including the use
249243 of berms, swales, and terraces; and
250244 (ii) the use of soil amendments that
251245 increase the water-holding capacity of the soil, including compost;
252246 (K) rainwater harvesting equipment and equipment
253247 to make use of water collected as part of a storm-water system
254248 installed for water quality control;
255249 (L) equipment for recycling or reuse of water
256250 originating on the premises or from other sources, including
257251 treated municipal effluent;
258252 (M) equipment needed to capture water from
259253 nonconventional, alternate sources, including air-conditioning
260254 condensate or graywater, for nonpotable uses;
261255 (N) metering or related equipment or systems that
262256 improve the accuracy of billable-revenue-generation systems;
263257 (O) alternative fuel programs resulting in
264258 energy cost savings and reduced emissions for local government
265259 vehicles, including fleet vehicles;
266260 (P) programs resulting in utility cost savings;
267261 or
268262 (Q) other energy or water conservation-related
269263 improvements or equipment, including improvements or equipment
270264 relating to renewable energy or nonconventional water sources or
271265 water reuse.
272266 SECTION 5. Section 302.004(a-1), Local Government Code, is
273267 amended to read as follows:
274268 (a-1) Notwithstanding other law, the governing body of a
275269 local government may use any available money[, other than money
276270 borrowed from this state,] to pay the provider of the energy or
277271 water conservation measures under this section, and the governing
278272 body is not required to pay for such costs solely out of the savings
279273 realized by the local government under an energy savings
280274 performance contract. The governing body may contract with the
281275 provider to perform work that is related to, connected with, or
282276 otherwise ancillary to the measures identified in the scope of an
283277 energy savings performance contract.
284278 SECTION 6. This Act takes effect immediately if it receives
285279 a vote of two-thirds of all the members elected to each house, as
286280 provided by Section 39, Article III, Texas Constitution. If this
287281 Act does not receive the vote necessary for immediate effect, this
288282 Act takes effect September 1, 2017.
