| 8 | 8 | | Texas Department of Transportation or a regional mobility |

| 9 | 9 | | authority. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 223.201(j), Transportation Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (j) Before the department may enter into a comprehensive |
|---|
| 14 | 14 | | development agreement under Subsection (f), the department must: |
|---|
| 15 | 15 | | (1) for a project other than the State Highway 99 |
|---|
| 16 | 16 | | (Grand Parkway) project, obtain, not later than August 31, 2023 |
|---|
| 17 | 17 | | [2017], the appropriate environmental clearance: |
|---|
| 18 | 18 | | (A) for the project; or |
|---|
| 19 | 19 | | (B) for the initial or base scope of the project |
|---|
| 20 | 20 | | if the project agreement provides for the phased construction of |
|---|
| 21 | 21 | | the project; and |
|---|
| 22 | 22 | | (2) present to the commission a full financial plan |
|---|
| 23 | 23 | | for the project, including costing methodology and cost proposals. |
|---|
| 24 | 24 | | SECTION 2. Sections 223.2011(a), (c), and (f), |
|---|
| 25 | 25 | | Transportation Code, are amended to read as follows: |
|---|
| 26 | 26 | | (a) Notwithstanding Sections 223.201(f) and 370.305(c), the |
|---|
| 27 | 27 | | department or an authority under Section 370.003 may enter into a |
|---|
| 28 | 28 | | comprehensive development agreement relating to improvements to, |
|---|
| 29 | 29 | | or construction of, all or part of: |
|---|
| 30 | 30 | | (1) the Loop 1 (MoPac Improvement) project from |
|---|
| 31 | 31 | | Farm-to-Market Road 734 to Cesar Chavez Street; |
|---|
| 32 | 32 | | (2) the U.S. 183 (Bergstrom Expressway) project from |
|---|
| 33 | 33 | | Springdale Road to Patton Avenue; |
|---|
| 34 | 34 | | (3) a project consisting of the construction of: |
|---|
| 35 | 35 | | (A) the Outer Parkway Project in Cameron County |
|---|
| 36 | 36 | | from U.S. Highway 77 to Farm-to-Market Road 1847; and |
|---|
| 37 | 37 | | (B) the South Padre Island Second Access Causeway |
|---|
| 38 | 38 | | Project from State Highway 100 to Park Road 100; |
|---|
| 39 | 39 | | (4) the Loop 49 project from Interstate 20 to U.S. |
|---|
| 40 | 40 | | Highway 69 (Lindale Relief Route) and from State Highway 110 to U.S. |
|---|
| 41 | 41 | | Highway 259 (Segments 6 and 7); |
|---|
| 42 | 42 | | (5) the Loop 375 Border Highway West project in El Paso |
|---|
| 43 | 43 | | County from Race Track Drive to U.S. Highway 54; |
|---|
| 44 | 44 | | (6) the Northeast Parkway project in El Paso County |
|---|
| 45 | 45 | | from Loop 375 east of the Railroad Drive overpass to the Texas-New |
|---|
| 46 | 46 | | Mexico border; |
|---|
| 47 | 47 | | (7) the Loop 1604 project in Bexar County; |
|---|
| 48 | 48 | | (8) the Hidalgo County Loop project; [and] |
|---|
| 49 | 49 | | (9) the International Bridge Trade Corridor project; |
|---|
| 50 | 50 | | and |
|---|
| 51 | 51 | | (10) the Farm-to-Market 1925 project from U.S. Highway |
|---|
| 52 | 52 | | 281 in Hidalgo County to U.S. Highway 77 in Cameron County. |
|---|
| 53 | 53 | | (c) Not later than December 1, 2018 [2014], the department |
|---|
| 54 | 54 | | or the authority, as applicable, shall provide a report to the |
|---|
| 55 | 55 | | commission on the status of a project described by Subsection |
|---|
| 56 | 56 | | (a). The report must include: |
|---|
| 57 | 57 | | (1) the status of the project's environmental |
|---|
| 58 | 58 | | clearance; |
|---|
| 59 | 59 | | (2) an explanation of any project delays; and |
|---|
| 60 | 60 | | (3) if the procurement is not completed, the |
|---|
| 61 | 61 | | anticipated date for the completion of the procurement. |
|---|
| 62 | 62 | | (f) The authority to enter into a comprehensive development |
|---|
| 63 | 63 | | agreement under this section expires August 31, 2023 [2017]. |
|---|
| 64 | 64 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 65 | 65 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 66 | 66 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 67 | 67 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 68 | 68 | | Act takes effect August 28, 2017. |
