55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to tuition and fee exemptions at public institutions of
88 higher education for certain military personnel dependents.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 54.341(a-2) and (b), Education Code,
1111 are amended to read as follows:
1212 (a-2) The exemptions provided for in Subsection (a) also
1313 apply to the spouse of:
1414 (1) a member of the armed forces of the United States:
1515 (A) who was killed in action;
1616 (B) who died while in service;
1717 (C) who is missing in action;
1818 (D) whose death is documented to be directly
1919 caused by illness or injury connected with service in the armed
2020 forces of the United States; or
2121 (E) who, as a result of a service-related injury:
2222 (i) became at least 80 percent disabled
2323 according to the disability ratings of the United States Department
2424 of Defense; or
2525 (ii) became totally and permanently disabled
2626 or meets the eligibility requirements for individual
2727 unemployability according to the disability ratings of the
2828 Department of Veterans Affairs [as a result of a service-related
2929 injury]; or
3030 (2) a member of the Texas National Guard or the Texas
3131 Air National Guard who:
3232 (A) was killed since January 1, 1946, while on
3333 active duty either in the service of this state or the United
3434 States; or
3535 (B) as a result of a service-related injury
3636 suffered since January 1, 1946, while on active duty either in the
3737 service of this state or the United States:
3838 (i) is at least 80 percent disabled
3939 according to the disability ratings of the United States Department
4040 of Defense, regardless of whether the member is eligible to receive
4141 disability benefits from the department; or
4242 (ii) is totally and permanently disabled or
4343 meets the eligibility requirements for individual unemployability
4444 according to the disability ratings of the Department of Veterans
4545 Affairs, regardless of whether the member is eligible to receive
4646 disability benefits from the department[, as a result of a
4747 service-related injury suffered since January 1, 1946, while on
4848 active duty either in the service of this state or the United
4949 States].
5050 (b) The exemptions provided for in Subsection (a) also apply
5151 to:
5252 (1) the children of members of the armed forces of the
5353 United States:
5454 (A) who are or were killed in action;
5555 (B) who die or died while in service;
5656 (C) who are missing in action;
5757 (D) whose death is documented to be directly
5858 caused by illness or injury connected with service in the armed
5959 forces of the United States; or
6060 (E) who, as a result of a service-related injury:
6161 (i) became at least 80 percent disabled
6262 according to the disability ratings of the United States Department
6363 of Defense; or
6464 (ii) became totally and permanently disabled
6565 or meet the eligibility requirements for individual
6666 unemployability according to the disability ratings of the
6767 Department of Veterans Affairs [as a result of a service-related
6868 injury]; and
6969 (2) the children of members of the Texas National
7070 Guard and the Texas Air National Guard who:
7171 (A) were killed since January 1, 1946, while on
7272 active duty either in the service of their state or the United
7373 States; or
7474 (B) as a result of a service-related injury
7575 suffered since January 1, 1946, while on active duty either in the
7676 service of this state or the United States:
7777 (i) are at least 80 percent disabled
7878 according to the disability ratings of the United States Department
7979 of Defense, regardless of whether the members are eligible to
8080 receive disability benefits from the department; or
8181 (ii) are totally and permanently disabled or
8282 meet the eligibility requirements for individual unemployability
8383 according to the disability ratings of the Department of Veterans
8484 Affairs, regardless of whether the members are eligible to receive
8585 disability benefits from the department[, as a result of a
8686 service-related injury suffered since January 1, 1946, while on
8787 active duty either in the service of this state or the United
8888 States].
8989 SECTION 2. Section 54.341, Education Code, as amended by
9090 this Act, applies to an exemption from the payment of all or part of
9191 tuition or other fees beginning with tuition and fees charged for
9292 the 2018 fall semester.
9393 SECTION 3. This Act takes effect September 1, 2017.
