55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the release on bail of a person arrested under a warrant
88 issued by the Texas Department of Criminal Justice or the Board of
99 Pardons and Paroles.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 508.254(d), Government Code, is amended
1212 to read as follows:
1313 (d) A magistrate of the county in which the person is held in
1414 custody may release the person on bond pending the hearing if [:
1515 [(1) the person is arrested or held in custody only on
1616 a charge that the person committed an administrative violation of
1717 release;
1818 [(2) the division, in accordance with Subsection (e),
1919 included notice on the warrant for the person's arrest that the
2020 person is eligible for release on bond; and
2121 [(3)] the magistrate determines that the person is not
2222 a threat to public safety.
2323 SECTION 2. Section 508.254(e), Government Code, is
2424 repealed.
2525 SECTION 3. The change in law made by this Act applies only
2626 to a person who is arrested on or after the effective date of this
2727 Act. A person arrested before the effective date of this Act is
2828 governed by the law in effect on the date the person was arrested,
2929 and the former law is continued in effect for that purpose.
3030 SECTION 4. This Act takes effect September 1, 2017.
