8 | 8 | issued by the Texas Department of Criminal Justice or the Board of | |

10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 508.254(d), Government Code, is amended | |
12 | 12 | to read as follows: | |
13 | 13 | (d) A magistrate of the county in which the person is held in | |
14 | 14 | custody may release the person on bond pending the hearing if [: | |
15 | 15 | [(1) the person is arrested or held in custody only on | |
16 | 16 | a charge that the person committed an administrative violation of | |
17 | 17 | release; | |
18 | 18 | [(2) the division, in accordance with Subsection (e), | |
19 | 19 | included notice on the warrant for the person's arrest that the | |
20 | 20 | person is eligible for release on bond; and | |
21 | 21 | [(3)] the magistrate determines that the person is not | |
22 | 22 | a threat to public safety. | |
23 | 23 | SECTION 2. Section 508.254(e), Government Code, is | |
24 | 24 | repealed. | |
25 | 25 | SECTION 3. The change in law made by this Act applies only | |
26 | 26 | to a person who is arrested on or after the effective date of this | |
27 | 27 | Act. A person arrested before the effective date of this Act is | |
28 | 28 | governed by the law in effect on the date the person was arrested, | |
29 | 29 | and the former law is continued in effect for that purpose. | |
30 | 30 | SECTION 4. This Act takes effect September 1, 2017. |
