108 relating to the powers and duties of the Department of Information
119 Resources regarding cybersecurity.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Subchapter C, Chapter 2054, Government Code, is
1412 amended by adding Sections 2054.0591 and 2054.0592 to read as
1513 follows:
1614 Sec. 2054.0591. CYBERSECURITY REPORT. (a) Not later than
1715 November 15 of each even-numbered year, the department shall submit
1816 to the governor, the lieutenant governor, the speaker of the house
1917 of representatives, and the standing committee of each house of the
2018 legislature with primary jurisdiction over state government
2119 operations a report identifying preventive and recovery efforts the
2220 state can undertake to improve cybersecurity in this state. The
2321 report must include:
2422 (1) an assessment of the resources available to
2523 address the operational and financial impacts of a cybersecurity
2624 event;
2725 (2) a review of existing statutes regarding
2826 cybersecurity and information resources technologies;
2927 (3) recommendations for legislative action to
3028 increase the state's cybersecurity and protect against adverse
3129 impacts from a cybersecurity event;
3230 (4) an evaluation of the costs and benefits of
3331 cybersecurity insurance; and
3432 (5) an evaluation of tertiary disaster recovery
3533 options.
3634 (b) The department or a recipient of a report under this
3735 section may redact or withhold information confidential under
3836 Chapter 552, including Section 552.139, or other state or federal
3937 law that is contained in the report in response to a request under
4038 Chapter 552 without the necessity of requesting a decision from the
4139 attorney general under Subchapter G, Chapter 552.
4240 Sec. 2054.0592. CYBERSECURITY EMERGENCY FUNDING. If a
4341 cybersecurity event creates a need for emergency funding, the
4442 department may request that the governor or Legislative Budget
4543 Board make a proposal under Chapter 317 to provide funding to manage
4644 the operational and financial impacts from the cybersecurity event.
4745 SECTION 2. This Act takes effect September 1, 2017.
