| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 546, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 546.008 to read as follows: |

| 12 | 12 | | Sec. 546.008. USE OF WARNING DEVICES BY STATIONARY |
|---|
| 13 | 13 | | AUTHORIZED EMERGENCY VEHICLES. The department shall: |
|---|
| 14 | 14 | | (1) develop best practices for the use of road flares, |
|---|
| 15 | 15 | | fusees, emergency reflectors, or other safety equipment by a |
|---|
| 16 | 16 | | stationary authorized emergency vehicle responding to an incident |
|---|
| 17 | 17 | | on a highway; and |
|---|
| 18 | 18 | | (2) provide training materials regarding the |
|---|
| 19 | 19 | | information developed under Subdivision (1) to operators of |
|---|
| 20 | 20 | | authorized emergency vehicles. |
|---|
| 21 | 21 | | SECTION 2. This Act takes effect September 1, 2017. |
