99 AN ACT
1010 relating to a voluntary temporary caregiver program providing
1111 temporary care for children removed from their homes.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 262, Family Code, is
1414 amended by adding Sections 262.1041 and 262.1042 to read as
1515 follows:
1616 Sec. 262.1041. VOLUNTARY TEMPORARY CAREGIVER PROGRAM. (a)
1717 The Department of Family and Protective Services shall create a
1818 program that allows a child who is removed from the child's home
1919 under this chapter to be placed in the care of an individual
2020 approved as a voluntary temporary caregiver under this section.
2121 (b) The department shall establish an application and
2222 verification process to approve individuals to serve as voluntary
2323 temporary caregivers. The department's verification process must:
2424 (1) include a background and criminal history record
2525 check of each caregiver;
2626 (2) verify the caregiver:
2727 (A) has a home with adequate sleeping space for
2828 each child placed with the caregiver;
2929 (B) has six or fewer children in the caregiver's
3030 home, including the caregiver's own children and any children for
3131 whom the caregiver provides day care;
3232 (C) agrees to nonphysical discipline;
3333 (D) has had all pets in the caregiver's home
3434 vaccinated; and
3535 (E) maintains and submits to the department proof
3636 of current certification in first aid and cardiopulmonary
3737 resuscitation issued by the American Red Cross, the American Heart
3838 Association, or another organization that provides equivalent
3939 training and certification;
4040 (3) require each member of the caregiver's household
4141 to undergo a screening test for tuberculosis infection approved by
4242 the executive commissioner of the Health and Human Services
4343 Commission; and
4444 (4) include any other administrative procedure the
4545 department determines is necessary to ensure the caregiver will
4646 provide a safe home for the child.
4747 (c) The department shall require each voluntary temporary
4848 caregiver to receive four hours of training relating to child
4949 development and disciplinary techniques for children who are
5050 classified above a basic service level. A caregiver who applies to
5151 become a licensed or verified foster home shall receive a credit of
5252 four hours toward the training hours required by Section 42.0537,
5353 Human Resources Code, for a person to become a licensed or verified
5454 foster home.
5555 (d) A voluntary temporary caregiver must agree to care for a
5656 child placed with the caregiver for at least 14 days.
5757 (e) Except as provided by Subsection (f), a child may be
5858 placed with a voluntary temporary caregiver for not more than 14
5959 days after the date the child is removed from the child's home.
6060 (f) If the child's caseworker determines that it is in the
6161 child's best interest for the child to remain in the care of the
6262 voluntary temporary caregiver for more than 14 days, the caseworker
6363 may, if the voluntary temporary caregiver agrees:
6464 (1) allow the child to remain in the care of the
6565 voluntary temporary caregiver;
6666 (2) designate the voluntary temporary caregiver as the
6767 caregiver of the child under a parental child safety placement
6868 agreement in accordance with Subchapter L, Chapter 264; or
6969 (3) designate the voluntary temporary caregiver as a
7070 designated caregiver of the child in accordance with Subchapter I,
7171 Chapter 264.
7272 (g) A voluntary temporary caregiver with whom a child is
7373 placed under this section is not entitled to any reimbursement for
7474 the care the caregiver provides for the child.
7575 (h) A voluntary temporary caregiver is not liable for the
7676 cost of any medical care the child receives while the child is
7777 placed with the caregiver. The cost of any medical care shall be
7878 covered by the existing health insurance provided for the child.
7979 (i) A voluntary temporary caregiver shall ensure that the
8080 child:
8181 (1) continues to attend the school in which the child
8282 was enrolled immediately before the child was removed from the
8383 child's home; or
8484 (2) attends another school chosen by the child's
8585 caseworker if the child's caseworker determines that it is unsafe
8686 for the child to continue to attend the school in which the child
8787 was enrolled immediately before the child was removed from the
8888 child's home.
8989 (j) The department shall publicize the voluntary temporary
9090 caregiver program and notify the parents of a child being removed
9191 from the child's home whether the child will be placed with a
9292 voluntary temporary caregiver.
9393 (k) The executive commissioner of the Health and Human
9494 Services Commission shall adopt rules necessary to implement this
9595 section.
9696 Sec. 262.1042. RELEASE OF CHILD BY LAW ENFORCEMENT OR
9797 JUVENILE PROBATION OFFICER TO VOLUNTARY TEMPORARY CAREGIVER. A law
9898 enforcement or juvenile probation officer who takes possession of a
9999 child under this chapter may release the child to a voluntary
100100 temporary caregiver approved under Section 262.1041.
101101 SECTION 2. As soon as practicable after the effective date
102102 of this Act:
103103 (1) the executive commissioner of the Health and Human
104104 Services Commission shall adopt rules necessary to implement the
105105 changes in law made by this Act; and
106106 (2) the Department of Family and Protective Services
107107 shall implement the voluntary temporary caregiver program as
108108 required by this Act.
109109 SECTION 3. This Act takes effect immediately if it receives
110110 a vote of two-thirds of all the members elected to each house, as
111111 provided by Section 39, Article III, Texas Constitution. If this
112112 Act does not receive the vote necessary for immediate effect, this
113113 Act takes effect September 1, 2017.
