77 AN ACT
88 relating to the issuance of specially marked driver's licenses and
99 personal identification certificates to disabled veterans.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 521.011, Transportation Code, is amended
1212 to read as follows:
1313 Sec. 521.011. SERVICES INFORMATION FOR VETERANS. The
1414 department and the Texas Veterans Commission shall jointly develop
1515 a one-page informational paper about veterans services provided by
1616 this state for veterans who receive:
1717 (1) a driver's license with a designation under
1818 Section 521.1235; or
1919 (2) a personal identification certificate with a
2020 [veteran's] designation under Section 521.102 [a one-page
2121 informational paper about veterans services provided by this
2222 state].
2323 SECTION 2. Section 521.101(l), Transportation Code, is
2424 amended to read as follows:
2525 (l) The application for the personal identification
2626 certificate must provide space for the applicant:
2727 (1) to voluntarily list any information [military
2828 service] that may qualify the applicant to receive a personal
2929 identification certificate with a [veteran's] designation under
3030 Section 521.102; and
3131 (2) to include proof required by the department to
3232 determine the applicant's eligibility to receive that designation.
3333 SECTION 3. Section 521.102, Transportation Code, is amended
3434 by amending Subsections (a) and (c) and adding Subsections (b-1),
3535 (d), (e), and (f) to read as follows:
3636 (a) In this section:
3737 (1) "Disability rating" has the meaning assigned by
3838 Section 11.22, Tax Code.
3939 (2) "Disabled veteran" and[,] "veteran" have the
4040 meanings assigned by Section 521.1235 [means a person who:
4141 [(1) has served in:
4242 [(A) the army, navy, air force, coast guard, or
4343 marine corps of the United States; or
4444 [(B) the Texas National Guard as defined by
4545 Section 431.001, Government Code; and
4646 [(2) has been honorably discharged from the branch of
4747 the service in which the person served].
4848 (b-1) If a disabled veteran provides proof sufficient to the
4949 department, the department, on request of the disabled veteran,
5050 shall include on a personal identification certificate issued to
5151 the disabled veteran in any available space on the face of the
5252 personal identification certificate or on the reverse side of the
5353 personal identification certificate:
5454 (1) a disabled veteran designation; and
5555 (2) the branch of the service in which the disabled
5656 veteran served.
5757 (c) The department shall provide to the recipient of a
5858 personal identification certificate with a [veteran's] designation
5959 under this section the informational paper described by Section
6060 521.011 at the time the certificate is issued.
6161 (d) Notwithstanding any other law and except as provided by
6262 Subsection (e), for purposes of obtaining a service or benefit
6363 available for disabled veterans in this state, a disabled veteran
6464 may use a personal identification certificate described by
6565 Subsection (b-1) as satisfactory proof:
6666 (1) that the disabled veteran has a disability rating
6767 described by Section 521.1235(a)(2)(A) or (B), as applicable; and
6868 (2) of branch of service and honorable discharge.
6969 (e) A personal identification certificate described by
7070 Subsection (b-1) is not satisfactory proof of the disabled
7171 veteran's disability rating for purposes of obtaining a property
7272 tax exemption provided by Chapter 11, Tax Code.
7373 (f) A disabled veteran who renews a personal identification
7474 certificate described by Subsection (b-1) shall provide proof
7575 sufficient to the department of the disabled veteran's disability
7676 rating.
7777 SECTION 4. Section 521.1235, Transportation Code, is
7878 amended by amending Subsections (a) and (c) and adding Subsections
7979 (b-1), (d), (e), and (f) to read as follows:
8080 (a) In this section:
8181 (1) "Disability rating" has the meaning assigned by
8282 Section 11.22, Tax Code.
8383 (2) "Disabled veteran" means a veteran who has
8484 suffered a service-connected disability with a disability rating
8585 of:
8686 (A) at least 50 percent; or
8787 (B) 40 percent if the rating is due to the
8888 amputation of a lower extremity.
8989 (3) "Veteran" [, "veteran"] means a person who:
9090 (A) [(1)] has served in:
9191 (i) [(A)] the army, navy, air force, coast
9292 guard, or marine corps of the United States; or
9393 (ii) [(B)] the Texas National Guard as
9494 defined by Section 437.001, Government Code; and
9595 (B) [(2)] has been honorably discharged from the
9696 branch of the service in which the person served.
9797 (b-1) If a disabled veteran provides proof sufficient to the
9898 department, the department, on request of the disabled veteran,
9999 shall include on a driver's license issued to the disabled veteran
100100 in any available space on the face of the driver's license or on the
101101 reverse side of the driver's license:
102102 (1) a disabled veteran designation; and
103103 (2) the branch of the service in which the disabled
104104 veteran served.
105105 (c) The department shall provide to the recipient of a
106106 driver's license with a [veteran's] designation under this section
107107 the informational paper described by Section 521.011 at the time
108108 the license is issued.
109109 (d) Notwithstanding any other law and except as provided by
110110 Subsection (e), for purposes of obtaining a service or benefit
111111 available for disabled veterans in this state, a disabled veteran
112112 may use a driver's license described by Subsection (b-1) as
113113 satisfactory proof:
114114 (1) that the disabled veteran has a disability rating
115115 described by Subsection (a)(2)(A) or (B), as applicable; and
116116 (2) of branch of service and honorable discharge.
117117 (e) A driver's license described by Subsection (b-1) is not
118118 satisfactory proof of the disabled veteran's disability rating for
119119 purposes of obtaining a property tax exemption provided by Chapter
120120 11, Tax Code.
121121 (f) A disabled veteran who renews a driver's license
122122 described by Subsection (b-1) shall provide proof sufficient to the
123123 department of the disabled veteran's disability rating.
124124 SECTION 5. Section 521.142(i), Transportation Code, is
125125 amended to read as follows:
126126 (i) The application must provide space for the applicant:
127127 (1) to voluntarily list any information [military
128128 service] that may qualify the applicant to receive a license with a
129129 [veteran's] designation under Section 521.1235; and
130130 (2) to include proof required by the department to
131131 determine the applicant's eligibility to receive that designation.
132132 SECTION 6. This Act takes effect September 1, 2017.
