104 AN ACT
115 relating to providing road powers to the Wood Trace Municipal
126 Utility District No. 1, of Montgomery County, Texas; providing
137 authority to issue bonds.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Section 8228.003(c), Special District Local Laws
1610 Code, as effective April 1, 2017, is amended to read as follows:
1711 (c) The creation of the district is essential to accomplish
1812 the purposes of:
1913 (1) a municipal utility district as provided by
2014 general law and Section 59, Article XVI, Texas Constitution; and
2115 (2) Section 52, Article III, Texas Constitution, that
2216 relate to the construction, acquisition, improvement, operation,
2317 or maintenance of macadamized, graveled, or paved roads, or
2418 improvements, including storm drainage, in aid of those roads.
2519 SECTION 2. Subchapter C, Chapter 8228, Special District
2620 Local Laws Code, as effective April 1, 2017, is amended by adding
2721 Sections 8228.102 and 8228.103 to read as follows:
2822 Sec. 8228.102. AUTHORITY FOR ROAD PROJECTS. Under Section
2923 52, Article III, Texas Constitution, the district may design,
3024 acquire, construct, finance, issue bonds for, improve, operate,
3125 maintain, and convey to this state, a county, or a municipality for
3226 operation and maintenance macadamized, graveled, or paved roads, or
3327 improvements, including storm drainage, in aid of those roads.
3428 Sec. 8228.103. ROAD STANDARDS AND REQUIREMENTS. (a) A road
3529 project must meet all applicable construction standards, zoning and
3630 subdivision requirements, and regulations of each municipality in
3731 whose corporate limits or extraterritorial jurisdiction the road
3832 project is located.
3933 (b) If a road project is not located in the corporate limits
4034 or extraterritorial jurisdiction of a municipality, the road
4135 project must meet all applicable construction standards,
4236 subdivision requirements, and regulations of each county in which
4337 the road project is located.
4438 (c) If the state will maintain and operate the road, the
4539 Texas Transportation Commission must approve the plans and
4640 specifications of the road project.
4741 SECTION 3. Chapter 8228, Special District Local Laws Code,
4842 as effective April 1, 2017, is amended by adding Subchapter D to
4943 read as follows:
5044 SUBCHAPTER D. BONDS
5145 Sec. 8228.151. BONDS FOR ROAD PROJECTS. At the time of
5246 issuance, the total principal amount of bonds or other obligations
5347 issued or incurred to finance road projects and payable from ad
5448 valorem taxes may not exceed one-fourth of the assessed value of the
5549 real property in the district.
5650 SECTION 4. (a) The legal notice of the intention to
5751 introduce this Act, setting forth the general substance of this
5852 Act, has been published as provided by law, and the notice and a
5953 copy of this Act have been furnished to all persons, agencies,
6054 officials, or entities to which they are required to be furnished
6155 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
6256 Government Code.
6357 (b) The governor, one of the required recipients, has
6458 submitted the notice and Act to the Texas Commission on
6559 Environmental Quality.
6660 (c) The Texas Commission on Environmental Quality has filed
6761 its recommendations relating to this Act with the governor, the
6862 lieutenant governor, and the speaker of the house of
6963 representatives within the required time.
7064 (d) All requirements of the constitution and laws of this
7165 state and the rules and procedures of the legislature with respect
7266 to the notice, introduction, and passage of this Act are fulfilled
7367 and accomplished.
7468 SECTION 5. This Act takes effect immediately if it receives
7569 a vote of two-thirds of all the members elected to each house, as
7670 provided by Section 39, Article III, Texas Constitution. If this
7771 Act does not receive the vote necessary for immediate effect, this
7872 Act takes effect September 1, 2017.
