10	4		AN ACT
11	5		relating to providing road powers to the Wood Trace Municipal
12	6		Utility District No. 1, of Montgomery County, Texas; providing
13	7		authority to issue bonds.
14	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	9		SECTION 1. Section 8228.003(c), Special District Local Laws
16	10		Code, as effective April 1, 2017, is amended to read as follows:
17	11		(c) The creation of the district is essential to accomplish
18	12		the purposes of:
19	13		(1) a municipal utility district as provided by
20	14		general law and Section 59, Article XVI, Texas Constitution; and
21	15		(2) Section 52, Article III, Texas Constitution, that
22	16		relate to the construction, acquisition, improvement, operation,
23	17		or maintenance of macadamized, graveled, or paved roads, or
24	18		improvements, including storm drainage, in aid of those roads.
25	19		SECTION 2. Subchapter C, Chapter 8228, Special District
26	20		Local Laws Code, as effective April 1, 2017, is amended by adding
27	21		Sections 8228.102 and 8228.103 to read as follows:
28	22		Sec. 8228.102. AUTHORITY FOR ROAD PROJECTS. Under Section
29	23		52, Article III, Texas Constitution, the district may design,
30	24		acquire, construct, finance, issue bonds for, improve, operate,
31	25		maintain, and convey to this state, a county, or a municipality for
32	26		operation and maintenance macadamized, graveled, or paved roads, or
33	27		improvements, including storm drainage, in aid of those roads.
34	28		Sec. 8228.103. ROAD STANDARDS AND REQUIREMENTS. (a) A road
35	29		project must meet all applicable construction standards, zoning and
36	30		subdivision requirements, and regulations of each municipality in
37	31		whose corporate limits or extraterritorial jurisdiction the road
38	32		project is located.
39	33		(b) If a road project is not located in the corporate limits
40	34		or extraterritorial jurisdiction of a municipality, the road
41	35		project must meet all applicable construction standards,
42	36		subdivision requirements, and regulations of each county in which
43	37		the road project is located.
44	38		(c) If the state will maintain and operate the road, the
45	39		Texas Transportation Commission must approve the plans and
46	40		specifications of the road project.
47	41		SECTION 3. Chapter 8228, Special District Local Laws Code,
48	42		as effective April 1, 2017, is amended by adding Subchapter D to
49	43		read as follows:
50	44		SUBCHAPTER D. BONDS
51	45		Sec. 8228.151. BONDS FOR ROAD PROJECTS. At the time of
52	46		issuance, the total principal amount of bonds or other obligations
53	47		issued or incurred to finance road projects and payable from ad
54	48		valorem taxes may not exceed one-fourth of the assessed value of the
55	49		real property in the district.
56	50		SECTION 4. (a) The legal notice of the intention to
57	51		introduce this Act, setting forth the general substance of this
58	52		Act, has been published as provided by law, and the notice and a
59	53		copy of this Act have been furnished to all persons, agencies,
60	54		officials, or entities to which they are required to be furnished
61	55		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
62	56		Government Code.
63	57		(b) The governor, one of the required recipients, has
64	58		submitted the notice and Act to the Texas Commission on
65	59		Environmental Quality.
66	60		(c) The Texas Commission on Environmental Quality has filed
67	61		its recommendations relating to this Act with the governor, the
68	62		lieutenant governor, and the speaker of the house of
69	63		representatives within the required time.
70	64		(d) All requirements of the constitution and laws of this
71	65		state and the rules and procedures of the legislature with respect
72	66		to the notice, introduction, and passage of this Act are fulfilled
73	67		and accomplished.
74	68		SECTION 5. This Act takes effect immediately if it receives
75	69		a vote of two-thirds of all the members elected to each house, as
76	70		provided by Section 39, Article III, Texas Constitution. If this
77	71		Act does not receive the vote necessary for immediate effect, this
78	72		Act takes effect September 1, 2017.
