55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to increasing the punishment for the offense of aggravated
88 promotion of prostitution.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 43.04(b), Penal Code, is amended to read
1111 as follows:
1212 (b) An offense under this section is a felony of the second
1313 [third] degree, except that the offense is a felony of the first
1414 degree if the prostitution enterprise uses as a prostitute one or
1515 more persons younger than 18 years of age, regardless of whether the
1616 actor knows the age of the person at the time of [the actor commits]
1717 the offense.
1818 SECTION 2. The change in law made by this Act applies only
1919 to an offense committed on or after the effective date of this Act.
2020 An offense committed before the effective date of this Act is
2121 governed by the law in effect on the date the offense was committed,
2222 and the former law is continued in effect for that purpose. For
2323 purposes of this section, an offense was committed before the
2424 effective date of this Act if any element of the offense occurred
2525 before that date.
2626 SECTION 3. This Act takes effect September 1, 2017.
