| 7 | 7 | | relating to increasing the punishment for the offense of promotion |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 43.03(b), Penal Code, is amended to read |
|---|
| 11 | 11 | | as follows: |
|---|
| 12 | 12 | | (b) An offense under this section is a state jail felony |
|---|
| 13 | 13 | | [Class A misdemeanor], except that the offense is: |
|---|
| 14 | 14 | | (1) a felony of the third degree [state jail felony] if |
|---|
| 15 | 15 | | the actor has been previously convicted of an offense under this |
|---|
| 16 | 16 | | section; or |
|---|
| 17 | 17 | | (2) a felony of the second degree if the actor engages |
|---|
| 18 | 18 | | in conduct described by Subsection (a)(1) or (2) involving a person |
|---|
| 19 | 19 | | younger than 18 years of age engaging in prostitution, regardless |
|---|
| 20 | 20 | | of whether the actor knows the age of the person at the time of [the |
|---|
| 21 | 21 | | actor commits] the offense. |

| 22 | 22 | | SECTION 2. The change in law made by this Act applies only to |
|---|
| 23 | 23 | | an offense committed on or after the effective date of this Act. An |
|---|
| 24 | 24 | | offense committed before the effective date of this Act is governed |
|---|
| 25 | 25 | | by the law in effect on the date the offense was committed, and the |
|---|
| 26 | 26 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 27 | 27 | | this section, an offense was committed before the effective date of |
|---|
| 28 | 28 | | this Act if any element of the offense occurred before that date. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2017. |
