6	6	AN ACT
7	7	relating to the acceptance of a voter at a polling place.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 15.022(a), Election Code, is amended to
10	10	read as follows:
11	11	(a) The registrar shall make the appropriate corrections in
12	12	the registration records, including, if necessary, deleting a
13	13	voter's name from the suspense list:
14	14	(1) after receipt of a notice of a change in
15	15	registration information under Section 15.021;
16	16	(2) after receipt of a voter's reply to a notice of
17	17	investigation given under Section 16.033;
18	18	(3) [after receipt of any affidavits executed under
19	19	Section 63.006, following an election;
20	20	[(4)] after receipt of a voter's statement of
21	21	residence executed under Section 63.0011;
22	22	(4) [(5)] before the effective date of the abolishment
23	23	of a county election precinct or a change in its boundary;
24	24	(5) [(6)] after receipt of United States Postal
25	25	Service information indicating an address reclassification;
26	26	(6) [(7)] after receipt of a voter's response under
27	27	Section 15.053; or
28	28	(7) [(8)] after receipt of a registration application
29	29	or change of address under Chapter 20.
30	30	SECTION 2. Section 63.006, Election Code, is amended to
31	31	read as follows:
32	32	Sec. 63.006. VOTER [WITH REQUIRED DOCUMENTATION] WHO IS NOT
33	33	ON LIST. (a) A voter who, when offering to vote, presents the
34	34	documentation required under Section 63.001(b) but whose name is
35	35	not on the precinct list of registered voters may [shall] be
36	36	accepted for provisional voting only under Section 63.011 [if the
37	37	voter also presents a voter registration certificate indicating
38	38	that the voter is currently registered:
39	39	[(1) in the precinct in which the voter is offering to
40	40	vote; or
41	41	[(2) in a different precinct in the same county as the
42	42	precinct in which the voter is offering to vote and the voter
43	43	executes an affidavit stating that the voter:
44	44	[(A) is a resident of the precinct in which the
45	45	voter is offering to vote or is otherwise entitled by law to vote in
46	46	that precinct;
47	47	[(B) was a resident of the precinct in which the
48	48	voter is offering to vote at the time the information on the voter's
49	49	residence address was last provided to the voter registrar;
50	50	[(C) did not deliberately provide false
51	51	information to secure registration in a precinct in which the voter
52	52	does not reside; and
53	53	[(D) is voting only once in the election].
54	54	(b) For a [After the] voter to whom this section applies [is
55	55	accepted], an election officer shall attempt to verify with the
56	56	voter registrar that the voter is a registered voter [:
57	57	[(1) indicate beside the voter's name on the poll list
58	58	that the voter was accepted under this section; and
59	59	[(2) enter the voter's name on the registration
60	60	omissions list].
61	61	SECTION 3. Section 63.011(a), Election Code, is amended to
62	62	read as follows:
63	63	(a) A person to whom Section 63.001(g) or 63.006 [63.009]
64	64	applies may cast a provisional ballot if the person executes an
65	65	affidavit stating that the person:
66	66	(1) is a registered voter in the precinct in which the
67	67	person seeks to vote; and
68	68	(2) is eligible to vote in the election.
69	69	SECTION 4. Section 66.0241, Election Code, is amended to
70	70	read as follows:
71	71	Sec. 66.0241. CONTENTS OF ENVELOPE NO. 4. Envelope no. 4
72	72	must contain:
73	73	(1) the precinct list of registered voters;
74	74	(2) the registration correction list;
75	75	(3) any statements of residence executed under Section
76	76	63.0011; and
77	77	(4) any affidavits executed under Section [63.006 or]
78	78	63.011.
79	79	SECTION 5. Section 63.009, Election Code, is repealed.
80	80	SECTION 6. This Act takes effect September 1, 2017.
