66 AN ACT
77 relating to the acceptance of a voter at a polling place.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 15.022(a), Election Code, is amended to
1010 read as follows:
1111 (a) The registrar shall make the appropriate corrections in
1212 the registration records, including, if necessary, deleting a
1313 voter's name from the suspense list:
1414 (1) after receipt of a notice of a change in
1515 registration information under Section 15.021;
1616 (2) after receipt of a voter's reply to a notice of
1717 investigation given under Section 16.033;
1818 (3) [after receipt of any affidavits executed under
1919 Section 63.006, following an election;
2020 [(4)] after receipt of a voter's statement of
2121 residence executed under Section 63.0011;
2222 (4) [(5)] before the effective date of the abolishment
2323 of a county election precinct or a change in its boundary;
2424 (5) [(6)] after receipt of United States Postal
2525 Service information indicating an address reclassification;
2626 (6) [(7)] after receipt of a voter's response under
2727 Section 15.053; or
2828 (7) [(8)] after receipt of a registration application
2929 or change of address under Chapter 20.
3030 SECTION 2. Section 63.006, Election Code, is amended to
3131 read as follows:
3232 Sec. 63.006. VOTER [WITH REQUIRED DOCUMENTATION] WHO IS NOT
3333 ON LIST. (a) A voter who, when offering to vote, presents the
3434 documentation required under Section 63.001(b) but whose name is
3535 not on the precinct list of registered voters may [shall] be
3636 accepted for provisional voting only under Section 63.011 [if the
3737 voter also presents a voter registration certificate indicating
3838 that the voter is currently registered:
3939 [(1) in the precinct in which the voter is offering to
4040 vote; or
4141 [(2) in a different precinct in the same county as the
4242 precinct in which the voter is offering to vote and the voter
4343 executes an affidavit stating that the voter:
4444 [(A) is a resident of the precinct in which the
4545 voter is offering to vote or is otherwise entitled by law to vote in
4646 that precinct;
4747 [(B) was a resident of the precinct in which the
4848 voter is offering to vote at the time the information on the voter's
4949 residence address was last provided to the voter registrar;
5050 [(C) did not deliberately provide false
5151 information to secure registration in a precinct in which the voter
5252 does not reside; and
5353 [(D) is voting only once in the election].
5454 (b) For a [After the] voter to whom this section applies [is
5555 accepted], an election officer shall attempt to verify with the
5656 voter registrar that the voter is a registered voter [:
5757 [(1) indicate beside the voter's name on the poll list
5858 that the voter was accepted under this section; and
5959 [(2) enter the voter's name on the registration
6060 omissions list].
6161 SECTION 3. Section 63.011(a), Election Code, is amended to
6262 read as follows:
6363 (a) A person to whom Section 63.001(g) or 63.006 [63.009]
6464 applies may cast a provisional ballot if the person executes an
6565 affidavit stating that the person:
6666 (1) is a registered voter in the precinct in which the
6767 person seeks to vote; and
6868 (2) is eligible to vote in the election.
6969 SECTION 4. Section 66.0241, Election Code, is amended to
7070 read as follows:
7171 Sec. 66.0241. CONTENTS OF ENVELOPE NO. 4. Envelope no. 4
7272 must contain:
7373 (1) the precinct list of registered voters;
7474 (2) the registration correction list;
7575 (3) any statements of residence executed under Section
7676 63.0011; and
7777 (4) any affidavits executed under Section [63.006 or]
7878 63.011.
7979 SECTION 5. Section 63.009, Election Code, is repealed.
8080 SECTION 6. This Act takes effect September 1, 2017.
