77 AN ACT
88 relating to the transportation or storage of a handgun or other
99 firearm or ammunition by a license holder in a motor vehicle in a
1010 parking area of a primary or secondary school.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter H, Chapter 411, Government Code, is
1313 amended by adding Section 411.2033 to read as follows:
1414 Sec. 411.2033. TRANSPORTATION OR STORAGE OF FIREARM AND
1515 AMMUNITION BY LICENSE HOLDER IN SCHOOL PARKING AREA. (a) In this
1616 section:
1717 (1) "Open-enrollment charter school" has the meaning
1818 assigned by Section 5.001, Education Code.
1919 (2) "Private school" has the meaning assigned by
2020 Section 22.081, Education Code.
2121 (b) A school district, open-enrollment charter school, or
2222 private school may not prohibit a person, including a school
2323 employee, who holds a license to carry a handgun under this
2424 subchapter from transporting or storing a handgun or other firearm
2525 or ammunition in a locked, privately owned or leased motor vehicle
2626 in a parking lot, parking garage, or other parking area provided by
2727 the district or charter or private school, provided that the
2828 handgun, firearm, or ammunition is not in plain view.
2929 (c) This section does not authorize a person to possess,
3030 store, or transport a handgun, firearm, or ammunition in violation
3131 of Section 37.125, Education Code, Section 46.03 or 46.035, Penal
3232 Code, or other law.
3333 SECTION 2. This Act takes effect September 1, 2017.
