| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter H, Chapter 411, Government Code, is |
|---|
| 13 | 13 | | amended by adding Section 411.2033 to read as follows: |
|---|
| 14 | 14 | | Sec. 411.2033. TRANSPORTATION OR STORAGE OF FIREARM AND |
|---|
| 15 | 15 | | AMMUNITION BY LICENSE HOLDER IN SCHOOL PARKING AREA. (a) In this |
|---|
| 16 | 16 | | section: |
|---|
| 17 | 17 | | (1) "Open-enrollment charter school" has the meaning |
|---|
| 18 | 18 | | assigned by Section 5.001, Education Code. |
|---|
| 19 | 19 | | (2) "Private school" has the meaning assigned by |
|---|
| 20 | 20 | | Section 22.081, Education Code. |
|---|
| 21 | 21 | | (b) A school district, open-enrollment charter school, or |
|---|
| 22 | 22 | | private school may not prohibit a person, including a school |
|---|
| 23 | 23 | | employee, who holds a license to carry a handgun under this |
|---|
| 24 | 24 | | subchapter from transporting or storing a handgun or other firearm |
|---|
| 25 | 25 | | or ammunition in a locked, privately owned or leased motor vehicle |
|---|
| 26 | 26 | | in a parking lot, parking garage, or other parking area provided by |
|---|
| 27 | 27 | | the district or charter or private school, provided that the |
|---|
| 28 | 28 | | handgun, firearm, or ammunition is not in plain view. |
|---|
| 29 | 29 | | (c) This section does not authorize a person to possess, |
|---|
| 30 | 30 | | store, or transport a handgun, firearm, or ammunition in violation |
|---|
| 31 | 31 | | of Section 37.125, Education Code, Section 46.03 or 46.035, Penal |
|---|
| 32 | 32 | | Code, or other law. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2017. |
