104 AN ACT
115 relating to procedures for the dissolution of the Bois D'Arc Island
126 Levee Improvement District of Dallas and Kaufman Counties.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Subchapter A, Chapter 7801, Special District
159 Local Laws Code, is amended by adding Section 7801.003 to read as
1610 follows:
1711 Sec. 7801.003. DISSOLUTION OF DISTRICT. (a) Not later than
1812 18 months after the next regularly scheduled election of directors
1913 under Section 7801.051, the Commissioners Courts of Dallas and
2014 Kaufman Counties may dissolve the district if:
2115 (1) at that election, the appropriate number of
2216 directors under Section 7801.051(c) are not elected; or
2317 (2) the directors elected at that election fail to
2418 attend 50 percent of the board meetings scheduled during the 12
2519 months following that election.
2620 (b) To dissolve the district under Subsection (a), the
2721 Commissioners Courts of Dallas County and Kaufman County each must
2822 issue an order dissolving the district. The orders must provide for
2923 the:
3024 (1) sale or transfer of the district's assets and
3125 liabilities;
3226 (2) administration of property, assets, and debts of
3327 the district until all money has been disposed of and all district
3428 debts have been paid or settled; and
3529 (3) continued provision of the district's services
3630 without interruption to the extent the district has been providing
3731 services.
3832 (c) The dissolution of the district and the sale or transfer
3933 of the district's assets and liabilities may not:
4034 (1) violate a trust indenture or bond resolution
4135 relating to the outstanding bonds of the district; or
4236 (2) diminish or impair the rights of the holders of
4337 outstanding bonds, warrants, or other obligations of the district.
4438 (d) This section expires January 1, 2020.
4539 SECTION 2. This Act takes effect September 1, 2017.
