13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 8 | | SECTION 1. Subchapter A, Chapter 7801, Special District |
---|
15 | 9 | | Local Laws Code, is amended by adding Section 7801.003 to read as |
---|
16 | 10 | | follows: |
---|
17 | 11 | | Sec. 7801.003. DISSOLUTION OF DISTRICT. (a) Not later than |
---|
18 | 12 | | 18 months after the next regularly scheduled election of directors |
---|
19 | 13 | | under Section 7801.051, the Commissioners Courts of Dallas and |
---|
20 | 14 | | Kaufman Counties may dissolve the district if: |
---|
21 | 15 | | (1) at that election, the appropriate number of |
---|
22 | 16 | | directors under Section 7801.051(c) are not elected; or |
---|
23 | 17 | | (2) the directors elected at that election fail to |
---|
24 | 18 | | attend 50 percent of the board meetings scheduled during the 12 |
---|
25 | 19 | | months following that election. |
---|
26 | 20 | | (b) To dissolve the district under Subsection (a), the |
---|
27 | 21 | | Commissioners Courts of Dallas County and Kaufman County each must |
---|
28 | 22 | | issue an order dissolving the district. The orders must provide for |
---|
29 | 23 | | the: |
---|
30 | 24 | | (1) sale or transfer of the district's assets and |
---|
31 | 25 | | liabilities; |
---|
32 | 26 | | (2) administration of property, assets, and debts of |
---|
33 | 27 | | the district until all money has been disposed of and all district |
---|
34 | 28 | | debts have been paid or settled; and |
---|
35 | 29 | | (3) continued provision of the district's services |
---|
36 | 30 | | without interruption to the extent the district has been providing |
---|
37 | 31 | | services. |
---|
38 | 32 | | (c) The dissolution of the district and the sale or transfer |
---|
39 | 33 | | of the district's assets and liabilities may not: |
---|
40 | 34 | | (1) violate a trust indenture or bond resolution |
---|
41 | 35 | | relating to the outstanding bonds of the district; or |
---|
42 | 36 | | (2) diminish or impair the rights of the holders of |
---|
43 | 37 | | outstanding bonds, warrants, or other obligations of the district. |
---|
44 | 38 | | (d) This section expires January 1, 2020. |
---|
45 | 39 | | SECTION 2. This Act takes effect September 1, 2017. |
