88 AN ACT
99 relating to the abolishment of certain advisory committees and
1010 other state entities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. RESIDENTIAL MORTGAGE FRAUD TASK FORCE. (a) The
1313 residential mortgage fraud task force is abolished.
1414 (b) Section 402.033, Government Code, is amended by
1515 amending Subsection (b) and adding Subsection (d) to read as
1616 follows:
1717 (b) If a person determines or reasonably suspects that
1818 fraudulent activity has been committed or is about to be committed,
1919 the person shall report the information to an authorized
2020 governmental agency. If a person reports the information to the
2121 attorney general, the attorney general shall notify an appropriate
2222 law enforcement agency with jurisdiction to investigate the
2323 fraudulent activity [each agency with representation on the
2424 residential mortgage fraud task force under Section 402.032]. If a
2525 financial institution or person voluntarily or pursuant to this
2626 section reports fraudulent activity to an authorized governmental
2727 agency, the financial institution or person may not notify any
2828 person involved in the fraudulent activity that the fraudulent
2929 activity has been reported, and the authorized governmental agency
3030 who has any knowledge that such report was made shall not disclose
3131 to any person involved in the fraudulent activity that the
3232 fraudulent activity has been reported. Any financial institution or
3333 person that makes a voluntary report of any possible violation of
3434 law or regulation to an authorized governmental agency shall not be
3535 liable to any person under any law or regulation of the state or the
3636 United States for such report.
3737 (d) An authorized governmental agency may share
3838 confidential information or information to which access is
3939 otherwise restricted by law with one or more other authorized
4040 governmental agencies. Except as provided by this subsection,
4141 confidential information that is shared under this subsection
4242 remains confidential and legal restrictions on access to the
4343 information apply.
4444 (c) Section 402.032, Government Code, is repealed.
4545 SECTION 2. ADVISORY OVERSIGHT COMMUNITY OUTREACH
4646 COMMITTEE. (a) The Advisory Oversight Community Outreach
4747 Committee is abolished.
4848 (b) Section 411.0197, Government Code, is repealed.
4949 SECTION 3. RAIN HARVESTING AND WATER RECYCLING TASK FORCE.
5050 (a) The task force under Section 2113.301(h), Government Code, as
5151 repealed by this section, is abolished.
5252 (b) Section 2113.301(h), Government Code, is repealed.
5353 SECTION 4. STATE COGENERATION COUNCIL. (a) The State
5454 Cogeneration Council is abolished. All rules adopted by the State
5555 Cogeneration Council are abolished.
5656 (b) Section 2302.024, Government Code, is amended to read as
5757 follows:
5858 Sec. 2302.024. AUTHORITY TO SELL POWER. A [(a) After the
5959 council has approved the application to construct or operate a
6060 cogeneration facility, a] cogenerating state agency may contract in
6161 the same manner as a qualifying facility for the sale to an electric
6262 utility of firm or nonfirm power produced by the state agency
6363 cogeneration facility that exceeds the agency's power
6464 requirements.
6565 [(b) A cogenerating state agency may consult with the
6666 council about the price or other terms of a contract entered under
6767 this section.]
6868 (c) The following provisions of the Government Code are
6969 repealed:
7070 (1) Section 2302.001(3);
7171 (2) Sections 2302.002, 2302.003, 2302.004, 2302.005,
7272 2302.006, and 2302.007;
7373 (3) Section 2302.021(a); and
7474 (4) Section 2302.022.
7575 SECTION 5. INFORMATION RESOURCES STEERING COMMITTEE. (a)
7676 The information resources steering committee is abolished.
7777 (b) Section 231.013, Family Code, is repealed.
7878 SECTION 6. PREMARITAL EDUCATION HANDBOOK ADVISORY
7979 COMMITTEE. (a) The advisory committee under Section 2.014(d),
8080 Family Code, as repealed by this section, is abolished.
8181 (b) Section 2.014(d), Family Code, is repealed.
8282 SECTION 7. INDEPENDENT REVIEW ORGANIZATION ADVISORY GROUP.
8383 (a) The advisory group under Section 4202.011, Insurance Code, as
8484 repealed by this section, is abolished.
8585 (b) Section 4202.011, Insurance Code, is repealed.
8686 SECTION 8. VEHICLE PROTECTION PRODUCT WARRANTOR ADVISORY
8787 BOARD. (a) The Vehicle Protection Product Warrantor Advisory
8888 Board is abolished.
8989 (b) Subchapter C, Chapter 2306, Occupations Code, is
9090 repealed.
9191 SECTION 9. ALTERNATIVE FUELS COUNCIL. (a) The Alternative
9292 Fuels Council is abolished.
9393 (b) On the effective date of this Act, a rule, form, policy,
9494 procedure, or decision of the Alternative Fuels Council continues
9595 in effect as a rule, form, policy, procedure, or decision of the
9696 comptroller of public accounts until superseded or repealed by an
9797 act of the comptroller.
9898 (c) A vehicle or other property to which Section 113.290,
9999 Natural Resources Code, as repealed by this section, applied may be
100100 transferred to another person.
101101 (d) Section 1232.106, Government Code, is amended to read as
102102 follows:
103103 Sec. 1232.106. EVALUATION OF APPLICATION FOR ASSISTANCE
104104 WITH ALTERNATIVE FUEL PROJECTS. (a) The comptroller [Alternative
105105 Fuels Council] shall evaluate an application by an eligible entity
106106 for the financing under Section 1232.104 of the acquisition,
107107 construction, or improvement of alternative fuels infrastructure
108108 and shall determine whether the proposed project will increase
109109 energy or cost savings to the applicant.
110110 (b) The authority may not issue an obligation under Section
111111 1232.104 unless the comptroller [Alternative Fuels Council]
112112 certifies that the proposed project will increase energy or cost
113113 savings to the applicant.
114114 (c) The comptroller [Alternative Fuels Council] by rule may
115115 adopt procedures and standards for the evaluation of an application
116116 for the financing of a proposed project under Section 1232.104.
117117 (e) Subchapter J, Chapter 113, Natural Resources Code, is
118118 repealed.
119119 SECTION 10. QUALIFIED AGRICULTURAL LAND AND QUALIFIED
120120 TIMBER LAND PROPERTY TAX VALUATION MANUALS APPROVAL COMMITTEES.
121121 (a) The committees under Sections 23.52(d) and 23.73(b), Tax Code,
122122 before amendment by this section, are abolished.
123123 (b) Section 23.52(d), Tax Code, is amended to read as
124124 follows:
125125 (d) The comptroller by rule shall develop and distribute to
126126 each appraisal office appraisal manuals setting forth this method
127127 of appraising qualified open-space land, and each appraisal office
128128 shall use the appraisal manuals in appraising qualified open-space
129129 land. The comptroller by rule shall develop and the appraisal
130130 office shall enforce procedures to verify that land meets the
131131 conditions contained in Subdivision (1) of Section 23.51 [of this
132132 code]. The rules, before taking effect, must be approved by the
133133 comptroller with the review and counsel of the Department of
134134 Agriculture [a majority vote of a committee comprised of the
135135 following officials or their designees: the governor, the
136136 comptroller, the attorney general, the agriculture commissioner,
137137 and the Commissioner of the General Land Office].
138138 (c) Section 23.73(b), Tax Code, is amended to read as
139139 follows:
140140 (b) The comptroller by rule shall develop and distribute to
141141 each appraisal office appraisal manuals setting forth this method
142142 of appraising qualified timber land, and each appraisal office
143143 shall use the appraisal manuals in appraising qualified timber
144144 land. The comptroller by rule shall develop and the appraisal
145145 office shall enforce procedures to verify that land meets the
146146 conditions contained in Section 23.72 [of this code]. The rules,
147147 before taking effect, must be approved by the comptroller with the
148148 review and counsel of the Texas A&M Forest Service [majority vote of
149149 a committee comprised of the following officials or their
150150 designees: the governor, the comptroller, the attorney general, the
151151 agriculture commissioner, and the Commissioner of the General Land
152152 Office].
153153 SECTION 11. COMMUNITIES IN SCHOOLS ADVISORY COMMITTEE. (a)
154154 The Communities in Schools advisory committee is abolished.
155155 (b) Section 16, Chapter 1156 (H.B. 2879), Acts of the 77th
156156 Legislature, Regular Session, 2001, is repealed.
157157 SECTION 12. EFFECTIVE DATE. This Act takes effect
158158 September 1, 2017.
