| 14 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 8 | | SECTION 1. Section 13.113(b), Agriculture Code, is amended |
|---|
| 16 | 9 | | to read as follows: |
|---|
| 17 | 10 | | (b) The department shall maintain the primary standards in a |
|---|
| 18 | 11 | | safe and suitable place in the offices of the department. The |
|---|
| 19 | 12 | | standards may not be moved except for repairs or |
|---|
| 20 | 13 | | certification. The department shall maintain the standards in |
|---|
| 21 | 14 | | good order and shall submit them to the National Institute of |
|---|
| 22 | 15 | | Standards and Technology or to a laboratory approved by the |
|---|
| 23 | 16 | | National Institute of Standards and Technology for certification as |
|---|
| 24 | 17 | | required to maintain recognition of the department's metrology |
|---|
| 25 | 18 | | laboratory [at least once each 10 years]. |
|---|
| 26 | 19 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 27 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 23 | | Act takes effect September 1, 2017. |
