66 AN ACT
77 relating to the inclusion of students receiving treatment in a
88 residential facility in the determination of dropout rates for
99 purposes of public school accountability.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subsection (f), Section 39.054, Education Code,
1212 as effective September 1, 2017, is transferred to Section 39.053,
1313 Education Code, redesignated as Subsection (g-3), Section 39.053,
1414 Education Code, and amended to read as follows:
1515 (g-3) [(f)] In the computation of dropout rates under
1616 Subsections (c)(4)(A)(i) [Sections 39.053(c)(4)(A)(i)] and
1717 (B)(ii)(a), a student who is released from a juvenile
1818 pre-adjudication secure detention facility or juvenile
1919 post-adjudication secure correctional facility and fails to enroll
2020 in school or a student who leaves a residential treatment center or
2121 facility, including a residential facility under Section 29.012,
2222 after receiving treatment [for fewer than 85 days] and fails to
2323 enroll in school may not be considered to have dropped out from the
2424 school district or campus serving the facility or center unless
2525 that district or campus is the one to which the student is regularly
2626 assigned. The agency may not limit an appeal relating to dropout
2727 computations under this subsection.
2828 SECTION 2. This Act takes effect September 1, 2017.
