55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the concurrent jurisdiction of the attorney general to
88 prosecute the offense of barratry and solicitation of professional
99 employment.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 38.12, Penal Code, is amended by adding
1212 Subsection (j) to read as follows:
1313 (j) The attorney general has concurrent jurisdiction with
1414 the appropriate local county or district attorney to prosecute an
1515 offense under this section.
1616 SECTION 2. The change in law made by this Act applies to the
1717 prosecution of an offense committed on or after the effective date
1818 of this Act. The prosecution of an offense committed before the
1919 effective date of this Act is governed by the law in effect on the
2020 date the offense was committed, and the former law is continued in
2121 effect for that purpose. For purposes of this section, an offense
2222 is committed before the effective date of this Act if any element of
2323 the offense occurs before the effective date.
2424 SECTION 3. This Act takes effect September 1, 2017.
