10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 38.12, Penal Code, is amended by adding | |
12 | 12 | Subsection (j) to read as follows: | |
13 | 13 | (j) The attorney general has concurrent jurisdiction with | |
14 | 14 | the appropriate local county or district attorney to prosecute an | |
15 | 15 | offense under this section. | |
16 | 16 | SECTION 2. The change in law made by this Act applies to the | |
17 | 17 | prosecution of an offense committed on or after the effective date | |
18 | 18 | of this Act. The prosecution of an offense committed before the | |
19 | 19 | effective date of this Act is governed by the law in effect on the | |
20 | 20 | date the offense was committed, and the former law is continued in | |
21 | 21 | effect for that purpose. For purposes of this section, an offense | |
22 | 22 | is committed before the effective date of this Act if any element of | |
23 | 23 | the offense occurs before the effective date. | |
24 | 24 | SECTION 3. This Act takes effect September 1, 2017. |
