55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study regarding the costs of educating students of
88 limited English proficiency in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 29, Education Code, is
1111 amended by adding Section 29.067 to read as follows:
1212 Sec. 29.067. STUDY REGARDING COSTS OF EDUCATING STUDENTS OF
1313 LIMITED ENGLISH PROFICIENCY; REPORT. (a) The agency shall conduct
1414 a study to examine the costs of educating a student of limited
1515 English proficiency in public schools. The study must:
1616 (1) determine whether the bilingual education
1717 allotment under Section 42.153 provides adequate funding to schools
1818 for meeting the educational needs of students of limited English
1919 proficiency;
2020 (2) if it is determined under Subdivision (1) that the
2121 bilingual education allotment is inadequate, determine the amount
2222 of adjustment for the bilingual education allotment that would
2323 provide adequate funding to schools for meeting the educational
2424 needs of students of limited English proficiency;
2525 (3) determine whether the educational needs of
2626 students of limited English proficiency and the costs of meeting
2727 those needs vary by grade level from kindergarten through the 12th
2828 grade; and
2929 (4) identify measures that may lower costs and improve
3030 outcomes, including:
3131 (A) implementation of:
3232 (i) new technologies;
3333 (ii) new teaching mediums; and
3434 (iii) new teaching techniques; and
3535 (B) changes to the duration of the academic
3636 calendar and school day.
3737 (b) Not later than January 1, 2018, the agency shall prepare
3838 a report detailing the results of the study under this section and
3939 submit the report to each standing legislative committee with
4040 primary jurisdiction over primary and secondary education.
4141 (c) This section expires September 1, 2018.
4242 SECTION 2. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2017.
