7 | 7 | | relating to the placement and use of video cameras in certain |
---|
8 | 8 | | self-contained classrooms or other settings providing special |
---|
9 | 9 | | education services. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 29.022, Education Code, is amended by |
---|
12 | 12 | | amending Subsections (a) and (b) and adding Subsection (a-1) to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | (a) In order to promote student safety, on receipt of a |
---|
15 | 15 | | request by a parent, trustee, governing body member, or staff |
---|
16 | 16 | | member that complies with Subsection (a-1), a school district or |
---|
17 | 17 | | open-enrollment charter school shall provide equipment, including |
---|
18 | 18 | | a video camera, to the [each] school or schools in the district or |
---|
19 | 19 | | the [each] charter school campus or campuses specified in the |
---|
20 | 20 | | request and in which a student who receives special education |
---|
21 | 21 | | services in a self-contained classroom or other special education |
---|
22 | 22 | | setting is enrolled. Each school or campus that receives equipment |
---|
23 | 23 | | shall place, operate, and maintain one or more video cameras in each |
---|
24 | 24 | | self-contained classroom or other special education setting to |
---|
25 | 25 | | which the parent's child or the staff member is assigned, if the |
---|
26 | 26 | | request was made by a parent or a staff member, and in which a |
---|
27 | 27 | | majority of the students in regular attendance are: |
---|
28 | 28 | | (1) provided special education and related services; |
---|
29 | 29 | | and |
---|
30 | 30 | | (2) assigned to a self-contained classroom or other |
---|
31 | 31 | | special education setting for at least 50 percent of the |
---|
32 | 32 | | instructional day. |
---|
33 | 33 | | (a-1) For purposes of Subsection (a): |
---|
34 | 34 | | (1) a parent may request equipment only for classrooms |
---|
35 | 35 | | or special education settings described by Subsection (a) to which |
---|
36 | 36 | | the parent's child is assigned; |
---|
37 | 37 | | (2) a trustee or governing body member may request |
---|
38 | 38 | | equipment only with approval by the board of trustees or governing |
---|
39 | 39 | | body; and |
---|
40 | 40 | | (3) a staff member may request equipment only for |
---|
41 | 41 | | classrooms or special education settings described by Subsection |
---|
42 | 42 | | (a) to which the staff member is assigned and only with approval by |
---|
43 | 43 | | the board of trustees or governing body. |
---|
44 | 44 | | (b) A school or campus that places a video camera in a |
---|
45 | 45 | | classroom or other special education setting in accordance with |
---|
46 | 46 | | Subsection (a) shall operate and maintain the camera in the |
---|
47 | 47 | | classroom or setting, as long as the classroom or setting continues |
---|
48 | 48 | | to satisfy the requirements under Subsection (a), for the remainder |
---|
49 | 49 | | of the school year in which the school or campus received the |
---|
50 | 50 | | request. At the end of each school year, the school or campus must |
---|
51 | 51 | | notify the requestor that operation of the video camera will not |
---|
52 | 52 | | continue during the following school year unless the school or |
---|
53 | 53 | | campus receives a new request authorized under this section for |
---|
54 | 54 | | that school year. |
---|
55 | 55 | | SECTION 2. This Act takes effect immediately if it receives |
---|
56 | 56 | | a vote of two-thirds of all the members elected to each house, as |
---|
57 | 57 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
58 | 58 | | Act does not receive the vote necessary for immediate effect, this |
---|
59 | 59 | | Act takes effect September 1, 2017. |
