66 AN ACT
77 relating to information sharing among care coordinators and
88 providers participating in the Medicaid managed care program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 533, Government Code, is
1111 amended by adding Section 533.00293 to read as follows:
1212 Sec. 533.00293. INFORMATION SHARING. (a) In this section:
1313 (1) "Care coordination" means assisting recipients to
1414 develop a plan of care, including a service plan, that meets the
1515 recipient's needs and coordinating the provision of Medicaid
1616 benefits in a manner that is consistent with the plan of care. The
1717 term is synonymous with "case management," "service coordination,"
1818 and "service management."
1919 (2) "Care coordinator" means a person, including a
2020 case manager, engaged by a Medicaid managed care organization to
2121 provide care coordination benefits.
2222 (b) To the extent permitted under applicable federal and
2323 state law enacted to protect the confidentiality and privacy of
2424 patients' health information, managed care organizations under
2525 contract with the commission to provide health care services to
2626 recipients shall ensure the sharing of information, including
2727 recipient medical records, among care coordinators and health care
2828 providers as appropriate to provide care coordination benefits.
2929 For purposes of implementing this section, a managed care
3030 organization may allow a care coordinator to share a recipient's
3131 service plan with health care providers, subject to the limitations
3232 of this section.
3333 SECTION 2. If before implementing any provision of this Act
3434 a state agency determines that a waiver or authorization from a
3535 federal agency is necessary for implementation of that provision,
3636 the agency affected by the provision shall request the waiver or
3737 authorization and may delay implementing that provision until the
3838 waiver or authorization is granted.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2017.
