7 | 7 | | relating to information sharing among care coordinators and |
---|
8 | 8 | | providers participating in the Medicaid managed care program. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter A, Chapter 533, Government Code, is |
---|
11 | 11 | | amended by adding Section 533.00293 to read as follows: |
---|
12 | 12 | | Sec. 533.00293. INFORMATION SHARING. (a) In this section: |
---|
13 | 13 | | (1) "Care coordination" means assisting recipients to |
---|
14 | 14 | | develop a plan of care, including a service plan, that meets the |
---|
15 | 15 | | recipient's needs and coordinating the provision of Medicaid |
---|
16 | 16 | | benefits in a manner that is consistent with the plan of care. The |
---|
17 | 17 | | term is synonymous with "case management," "service coordination," |
---|
18 | 18 | | and "service management." |
---|
19 | 19 | | (2) "Care coordinator" means a person, including a |
---|
20 | 20 | | case manager, engaged by a Medicaid managed care organization to |
---|
21 | 21 | | provide care coordination benefits. |
---|
22 | 22 | | (b) To the extent permitted under applicable federal and |
---|
23 | 23 | | state law enacted to protect the confidentiality and privacy of |
---|
24 | 24 | | patients' health information, managed care organizations under |
---|
25 | 25 | | contract with the commission to provide health care services to |
---|
26 | 26 | | recipients shall ensure the sharing of information, including |
---|
27 | 27 | | recipient medical records, among care coordinators and health care |
---|
28 | 28 | | providers as appropriate to provide care coordination benefits. |
---|
29 | 29 | | For purposes of implementing this section, a managed care |
---|
30 | 30 | | organization may allow a care coordinator to share a recipient's |
---|
31 | 31 | | service plan with health care providers, subject to the limitations |
---|
32 | 32 | | of this section. |
---|
33 | 33 | | SECTION 2. If before implementing any provision of this Act |
---|
34 | 34 | | a state agency determines that a waiver or authorization from a |
---|
35 | 35 | | federal agency is necessary for implementation of that provision, |
---|
36 | 36 | | the agency affected by the provision shall request the waiver or |
---|
37 | 37 | | authorization and may delay implementing that provision until the |
---|
38 | 38 | | waiver or authorization is granted. |
---|
39 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
---|
40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
---|
41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
---|
43 | 43 | | Act takes effect September 1, 2017. |
