99 relating to certain authorizations or approvals issued by the Texas
1010 Private Security Board.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1702.163(g), Occupations Code, is
1313 amended to read as follows:
1414 (g) Chapter 53 does not apply to a determination of whether
1515 an applicant is disqualified from owning or possessing a firearm as
1616 provided by Subsection (b)(1) and an [An] individual's eligibility
1717 under that subsection [this section] is not affected by a
1818 relationship or lack of relationship between the nature of a
1919 criminal charge or conviction and the regulated occupation.
2020 SECTION 2. Section 1702.1685(c), Occupations Code, is
2121 amended to read as follows:
2222 (c) An applicant for a security officer commission must
2323 demonstrate the required proficiency not earlier than the 90th day
2424 [within the 90-day period] before the date the application for the
2525 security officer commission is submitted [issued].
2626 SECTION 3. Section 1702.301, Occupations Code, is amended
2727 by amending Subsections (b), (g), and (h) and adding Subsection
2828 (b-1) to read as follows:
2929 (b) Except as provided by Subsection (b-1), a [A] security
3030 officer commission expires on the second anniversary of the date
3131 the commission is issued.
3232 (b-1) A security officer commission issued to a person who
3333 is not a citizen, national, or legal permanent resident of the
3434 United States or a refugee or asylee lawfully admitted into the
3535 United States expires on the earlier of:
3636 (1) the second anniversary of the date the commission
3737 is issued; or
3838 (2) the expiration of the person's lawful presence in
3939 the United States as determined by the appropriate United States
4040 agency in compliance with federal law.
4141 (g) A letter of authority[,] or a school approval [or school
4242 instructor approval] letter issued by the board[,] expires on the
4343 first anniversary of the date of issuance.
4444 (h) A license, registration, instructor approval letter, or
4545 endorsement issued under this chapter, other than one specified in
4646 this section, expires on the date specified by this chapter or by
4747 board rule.
4848 SECTION 4. (a) Sections 1702.163(g) and 1702.1685(c),
4949 Occupations Code, as amended by this Act, apply only to an
5050 application for an original or renewal security officer commission
5151 that is submitted on or after the effective date of this Act. An
5252 application submitted before the effective date of this Act is
5353 governed by the law in effect on the date the application was
5454 submitted, and the former law is continued in effect for that
5555 purpose.
5656 (b) Section 1702.301, Occupations Code, as amended by this
5757 Act, applies only to a security officer commission or an instructor
5858 approval letter issued or renewed on or after the effective date of
5959 this Act. A security officer commission or an instructor approval
6060 letter issued or renewed before the effective date of this Act is
6161 governed by the law in effect on the date the security officer
6262 commission or instructor approval letter was issued or renewed, and
6363 the former law is continued in effect for that purpose.
6464 SECTION 5. This Act takes effect September 1, 2017.
