8	8	AN ACT
9	9	relating to certain authorizations or approvals issued by the Texas
10	10	Private Security Board.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 1702.163(g), Occupations Code, is
13	13	amended to read as follows:
14	14	(g) Chapter 53 does not apply to a determination of whether
15	15	an applicant is disqualified from owning or possessing a firearm as
16	16	provided by Subsection (b)(1) and an [An] individual's eligibility
17	17	under that subsection [this section] is not affected by a
18	18	relationship or lack of relationship between the nature of a
19	19	criminal charge or conviction and the regulated occupation.
20	20	SECTION 2. Section 1702.1685(c), Occupations Code, is
21	21	amended to read as follows:
22	22	(c) An applicant for a security officer commission must
23	23	demonstrate the required proficiency not earlier than the 90th day
24	24	[within the 90-day period] before the date the application for the
25	25	security officer commission is submitted [issued].
26	26	SECTION 3. Section 1702.301, Occupations Code, is amended
27	27	by amending Subsections (b), (g), and (h) and adding Subsection
28	28	(b-1) to read as follows:
29	29	(b) Except as provided by Subsection (b-1), a [A] security
30	30	officer commission expires on the second anniversary of the date
31	31	the commission is issued.
32	32	(b-1) A security officer commission issued to a person who
33	33	is not a citizen, national, or legal permanent resident of the
34	34	United States or a refugee or asylee lawfully admitted into the
35	35	United States expires on the earlier of:
36	36	(1) the second anniversary of the date the commission
37	37	is issued; or
38	38	(2) the expiration of the person's lawful presence in
39	39	the United States as determined by the appropriate United States
40	40	agency in compliance with federal law.
41	41	(g) A letter of authority[,] or a school approval [or school
42	42	instructor approval] letter issued by the board[,] expires on the
43	43	first anniversary of the date of issuance.
44	44	(h) A license, registration, instructor approval letter, or
45	45	endorsement issued under this chapter, other than one specified in
46	46	this section, expires on the date specified by this chapter or by
47	47	board rule.
48	48	SECTION 4. (a) Sections 1702.163(g) and 1702.1685(c),
49	49	Occupations Code, as amended by this Act, apply only to an
50	50	application for an original or renewal security officer commission
51	51	that is submitted on or after the effective date of this Act. An
52	52	application submitted before the effective date of this Act is
53	53	governed by the law in effect on the date the application was
54	54	submitted, and the former law is continued in effect for that
55	55	purpose.
56	56	(b) Section 1702.301, Occupations Code, as amended by this
57	57	Act, applies only to a security officer commission or an instructor
58	58	approval letter issued or renewed on or after the effective date of
59	59	this Act. A security officer commission or an instructor approval
60	60	letter issued or renewed before the effective date of this Act is
61	61	governed by the law in effect on the date the security officer
62	62	commission or instructor approval letter was issued or renewed, and
63	63	the former law is continued in effect for that purpose.
64	64	SECTION 5. This Act takes effect September 1, 2017.
