A BILL TO BE ENTITLED
AN ACT
relating to the deposit of certain fees for permits for oversize or
overweight vehicles to the credit of the Texas Department of Motor
Vehicles fund.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter E, Chapter 621, Transportation Code,
is amended by adding Section 621.357 to read as follows:
Sec. 621.357. DEPOSIT OF CERTAIN FEE AMOUNTS TO TEXAS
DEPARTMENT OF MOTOR VEHICLES FUND. (a) This section applies only
to a provision of this subtitle enacted after January 1, 2017, that
authorizes a new permit fee and does not expressly provide for a
portion of the fee to be deposited to the credit of the Texas
Department of Motor Vehicles fund.
(b) Notwithstanding any other provision of this subtitle,
10 percent of a fee collected for the issuance of a permit by the
department under this subtitle shall be deposited to the credit of
the Texas Department of Motor Vehicles fund and the remainder of the
fee collected shall be proportionally adjusted, if necessary, and
distributed as otherwise provided by this subtitle.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2017.
