| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter E, Chapter 621, Transportation Code, |
|---|
| 12 | 12 | | is amended by adding Section 621.357 to read as follows: |
|---|
| 13 | 13 | | Sec. 621.357. DEPOSIT OF CERTAIN FEE AMOUNTS TO TEXAS |
|---|
| 14 | 14 | | DEPARTMENT OF MOTOR VEHICLES FUND. (a) This section applies only |
|---|
| 15 | 15 | | to a provision of this subtitle enacted after January 1, 2017, that |
|---|
| 16 | 16 | | authorizes a new permit fee and does not expressly provide for a |
|---|
| 17 | 17 | | portion of the fee to be deposited to the credit of the Texas |
|---|
| 18 | 18 | | Department of Motor Vehicles fund. |
|---|
| 19 | 19 | | (b) Notwithstanding any other provision of this subtitle, |
|---|
| 20 | 20 | | 10 percent of a fee collected for the issuance of a permit by the |
|---|
| 21 | 21 | | department under this subtitle shall be deposited to the credit of |
|---|
| 22 | 22 | | the Texas Department of Motor Vehicles fund and the remainder of the |
|---|
| 23 | 23 | | fee collected shall be proportionally adjusted, if necessary, and |
|---|
| 24 | 24 | | distributed as otherwise provided by this subtitle. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2017. |
