| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 3891, Special District |
|---|
| 11 | 11 | | Local Laws Code, is amended by adding Section 3891.109 to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | Sec. 3891.109. ENFORCEMENT OF REAL PROPERTY RESTRICTIONS. |
|---|
| 14 | 14 | | The district may enforce a real property restriction in the manner |
|---|
| 15 | 15 | | provided by Section 54.237, Water Code, if, in the reasonable |
|---|
| 16 | 16 | | judgment of the board, the enforcement of the restriction is |
|---|
| 17 | 17 | | necessary. |
|---|
| 18 | 18 | | SECTION 2. Subchapter D, Chapter 3891, Special District |
|---|
| 19 | 19 | | Local Laws Code, is amended by adding Section 3891.159 to read as |
|---|
| 20 | 20 | | follows: |
|---|
| 21 | 21 | | Sec. 3891.159. POWERS OF MUNICIPAL UTILITY DISTRICT TO |
|---|
| 22 | 22 | | ESTABLISH DEFINED AREAS AND DESIGNATED PROPERTY; TAXES; BONDS. (a) |
|---|
| 23 | 23 | | The district has the powers of a municipal utility district under |
|---|
| 24 | 24 | | Subchapter J, Chapter 54, Water Code, including the power to: |
|---|
| 25 | 25 | | (1) implement a plan; |
|---|
| 26 | 26 | | (2) issue bonds; and |
|---|
| 27 | 27 | | (3) impose a tax in a defined area established under |
|---|
| 28 | 28 | | that subchapter. |
|---|
| 29 | 29 | | (b) The district may exercise the powers described by |
|---|
| 30 | 30 | | Subsection (a) regardless of whether the district is composed of |
|---|
| 31 | 31 | | the minimum number of acres provided by Section 54.801, Water Code. |
|---|
| 32 | 32 | | SECTION 3. (a) The legal notice of the intention to |
|---|
| 33 | 33 | | introduce this Act, setting forth the general substance of this |
|---|
| 34 | 34 | | Act, has been published as provided by law, and the notice and a |
|---|
| 35 | 35 | | copy of this Act have been furnished to all persons, agencies, |
|---|
| 36 | 36 | | officials, or entities to which they are required to be furnished |
|---|
| 37 | 37 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
|---|
| 38 | 38 | | Government Code. |
|---|
| 39 | 39 | | (b) The governor, one of the required recipients, has |
|---|
| 40 | 40 | | submitted the notice and Act to the Texas Commission on |
|---|
| 41 | 41 | | Environmental Quality. |
|---|
| 42 | 42 | | (c) The Texas Commission on Environmental Quality has filed |
|---|
| 43 | 43 | | its recommendations relating to this Act with the governor, |
|---|
| 44 | 44 | | lieutenant governor, and speaker of the house of representatives |
|---|
| 45 | 45 | | within the required time. |
|---|
| 46 | 46 | | (d) The general law relating to consent by political |
|---|
| 47 | 47 | | subdivisions to the creation of districts with conservation, |
|---|
| 48 | 48 | | reclamation, and road powers and the inclusion of land in those |
|---|
| 49 | 49 | | districts has been complied with. |
|---|
| 50 | 50 | | (e) All requirements of the constitution and laws of this |
|---|
| 51 | 51 | | state and the rules and procedures of the legislature with respect |
|---|
| 52 | 52 | | to the notice, introduction, and passage of this Act have been |
|---|
| 53 | 53 | | fulfilled and accomplished. |
|---|
| 54 | 54 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 58 | 58 | | Act takes effect September 1, 2017. |
