7 | 7 | | relating to the ability of certain students to enroll full-time in |

8 | 8 | | courses provided through the state virtual school network. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 30A.002(b), Education Code, is amended |
---|
11 | 11 | | to read as follows: |
---|
12 | 12 | | (b) A student is eligible to enroll full-time in courses |
---|
13 | 13 | | provided through the state virtual school network only if the |
---|
14 | 14 | | student: |
---|
15 | 15 | | (1) was enrolled in a public school in this state in |
---|
16 | 16 | | the preceding school year; or |
---|
17 | 17 | | (2) [has been placed in substitute care in this |
---|
18 | 18 | | state,] regardless of whether the student was enrolled in a public |
---|
19 | 19 | | school in this state in the preceding school year: |
---|
20 | 20 | | (A) has been placed in substitute care in this |
---|
21 | 21 | | state; or |
---|
22 | 22 | | (B) has been prescribed by a licensed |
---|
23 | 23 | | psychologist or other licensed health care professional to attend |
---|
24 | 24 | | school through an alternative setting that provides instruction |
---|
25 | 25 | | solely through electronic courses because of the student's medical |
---|
26 | 26 | | or psychological condition. |
---|
27 | 27 | | SECTION 2. Section 30A.107(c), Education Code, is amended |
---|
28 | 28 | | to read as follows: |
---|
29 | 29 | | (c) A student who resides in this state but who is not |
---|
30 | 30 | | enrolled in a school district or open-enrollment charter school in |
---|
31 | 31 | | this state as a full-time student may, subject to Section 30A.155, |
---|
32 | 32 | | enroll in electronic courses through the state virtual school |
---|
33 | 33 | | network. A student to whom this subsection applies: |
---|
34 | 34 | | (1) [may not in any semester enroll in more than two |
---|
35 | 35 | | electronic courses offered through the state virtual school |
---|
36 | 36 | | network; |
---|
37 | 37 | | [(2)] is not considered to be a public school student; |
---|
38 | 38 | | (2) [(3)] must obtain access to a course provided |
---|
39 | 39 | | through the network through the school district or open-enrollment |
---|
40 | 40 | | charter school attendance zone in which the student resides; |
---|
41 | 41 | | (3) [(4)] is not entitled to enroll in a course |
---|
42 | 42 | | offered by a school district or open-enrollment charter school |
---|
43 | 43 | | other than an electronic course provided through the network; and |
---|
44 | 44 | | (4) [(5)] is not entitled to any right, privilege, |
---|
45 | 45 | | activities, or services available to a student enrolled in a public |
---|
46 | 46 | | school, other than the right to receive the appropriate unit of |
---|
47 | 47 | | credit for completing an electronic course. |
---|
48 | 48 | | SECTION 3. This Act applies beginning with the 2017-2018 |
---|
49 | 49 | | school year. |
---|
50 | 50 | | SECTION 4. This Act takes effect immediately if it receives |
---|
51 | 51 | | a vote of two-thirds of all the members elected to each house, as |
---|
52 | 52 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
53 | 53 | | Act does not receive the vote necessary for immediate effect, this |
---|
54 | 54 | | Act takes effect September 1, 2017. |
