55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the ability of certain students to enroll full-time in
88 courses provided through the state virtual school network.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 30A.002(b), Education Code, is amended
1111 to read as follows:
1212 (b) A student is eligible to enroll full-time in courses
1313 provided through the state virtual school network only if the
1414 student:
1515 (1) was enrolled in a public school in this state in
1616 the preceding school year; or
1717 (2) [has been placed in substitute care in this
1818 state,] regardless of whether the student was enrolled in a public
1919 school in this state in the preceding school year:
2020 (A) has been placed in substitute care in this
2121 state; or
2222 (B) has been prescribed by a licensed
2323 psychologist or other licensed health care professional to attend
2424 school through an alternative setting that provides instruction
2525 solely through electronic courses because of the student's medical
2626 or psychological condition.
2727 SECTION 2. Section 30A.107(c), Education Code, is amended
2828 to read as follows:
2929 (c) A student who resides in this state but who is not
3030 enrolled in a school district or open-enrollment charter school in
3131 this state as a full-time student may, subject to Section 30A.155,
3232 enroll in electronic courses through the state virtual school
3333 network. A student to whom this subsection applies:
3434 (1) [may not in any semester enroll in more than two
3535 electronic courses offered through the state virtual school
3636 network;
3737 [(2)] is not considered to be a public school student;
3838 (2) [(3)] must obtain access to a course provided
3939 through the network through the school district or open-enrollment
4040 charter school attendance zone in which the student resides;
4141 (3) [(4)] is not entitled to enroll in a course
4242 offered by a school district or open-enrollment charter school
4343 other than an electronic course provided through the network; and
4444 (4) [(5)] is not entitled to any right, privilege,
4545 activities, or services available to a student enrolled in a public
4646 school, other than the right to receive the appropriate unit of
4747 credit for completing an electronic course.
4848 SECTION 3. This Act applies beginning with the 2017-2018
4949 school year.
5050 SECTION 4. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2017.
