9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 2306.6716, Government Code, is amended | |
11 | 11 | by adding Subsection (e) to read as follows: | |
12 | 12 | (e) The department shall reject and return an application | |
13 | 13 | for a low income housing tax credit commitment in the initial | |
14 | 14 | allocation cycle if the applicant does not pay the total amount of | |
15 | 15 | application fees on or before the application filing deadline | |
16 | 16 | established under Section 2306.6724(d). | |
17 | 17 | SECTION 2. The change in law made by this Act applies only | |
18 | 18 | to an application for low income housing tax credits that is | |
19 | 19 | submitted to the Texas Department of Housing and Community Affairs | |
20 | 20 | during an application cycle that is based on the 2018 qualified | |
21 | 21 | allocation plan or a subsequent plan adopted by the governing board | |
22 | 22 | of the department under Section 2306.67022, Government Code. An | |
23 | 23 | application that is submitted during an application cycle that is | |
24 | 24 | based on an earlier qualified allocation plan is governed by the law | |
25 | 25 | in effect on the date the application cycle began, and the former | |
26 | 26 | law is continued in effect for that purpose. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2017. |
