8 | 8 | | public institutions of higher education. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter B, Chapter 54, Education Code, is |
---|
11 | 11 | | amended by adding Section 54.0514 to read as follows: |
---|
12 | 12 | | Sec. 54.0514. LIMITATION ON TOTAL AMOUNT OF TUITION. (a) |
---|
13 | 13 | | In this section: |
---|
14 | 14 | | (1) "General academic teaching institution" has the |
---|
15 | 15 | | meaning assigned by Section 61.003. |
---|
16 | 16 | | (2) "Tuition" includes: |
---|
17 | 17 | | (A) tuition for which the rates are prescribed by |
---|
18 | 18 | | this chapter; and |
---|
19 | 19 | | (B) tuition charged by a general academic |
---|
20 | 20 | | teaching institution under Section 54.0513 or another law |
---|
21 | 21 | | authorizing an institution to establish tuition rates. |
---|
22 | 22 | | (a-1) Notwithstanding Section 54.0513 or another law |
---|
23 | 23 | | authorizing an institution to establish tuition rates, the total |
---|
24 | 24 | | amount of tuition charged by a general academic teaching |
---|
25 | 25 | | institution to a student for the 2018-2019, 2019-2020, 2020-2021, |
---|
26 | 26 | | or 2021-2022 academic year may not exceed the total amount of |
---|
27 | 27 | | tuition that the institution would have charged under this chapter |
---|
28 | 28 | | to a similarly situated student for the 2016-2017 academic year. |
---|
29 | 29 | | This subsection expires August 31, 2022. |
---|
30 | 30 | | (b) Notwithstanding Section 54.0513 or another law |
---|
31 | 31 | | authorizing an institution to establish tuition rates, the total |
---|
32 | 32 | | amount of tuition charged by a general academic teaching |
---|
33 | 33 | | institution to a student for the 2022-2023 academic year or a |
---|
34 | 34 | | subsequent academic year may not exceed the total amount of tuition |
---|
35 | 35 | | that the institution would have charged under this chapter to a |
---|
36 | 36 | | similarly situated student for the 2016-2017 academic year by more |
---|
37 | 37 | | than 65 percent. |
---|
38 | 38 | | (c) For purposes of this section, students are similarly |
---|
39 | 39 | | situated if they share the same residency status, degree program, |
---|
40 | 40 | | course load, course level, tuition exemption status, and other |
---|
41 | 41 | | circumstances affecting the tuition charged to the student. |
---|
42 | 42 | | (d) This section does not ensure that the total amount of |
---|
43 | 43 | | tuition charged to an individual student does not increase based on |
---|
44 | 44 | | a change in the student's residency status, degree program, course |
---|
45 | 45 | | load, course level, tuition exemption status, or other circumstance |
---|
46 | 46 | | affecting the tuition charged to the student. |
---|
47 | 47 | | (e) The Texas Higher Education Coordinating Board may adopt |
---|
48 | 48 | | rules as necessary to administer this section. |
---|
49 | 49 | | SECTION 2. This Act takes effect immediately if it receives |
---|
50 | 50 | | a vote of two-thirds of all the members elected to each house, as |
---|
51 | 51 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
52 | 52 | | Act does not receive the vote necessary for immediate effect, this |
---|
53 | 53 | | Act takes effect September 1, 2017. |
