66 AN ACT
77 relating to the sunset review of the Legislative Budget Board and a
88 study by the comptroller on the accuracy of fiscal notes prepared by
99 the Legislative Budget Board.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 322, Government Code, is amended by
1212 adding Section 322.026 to read as follows:
1313 Sec. 322.026. SUNSET PROVISION. The Legislative Budget
1414 Board is subject to Chapter 325 (Texas Sunset Act). Unless
1515 continued in existence as provided by that chapter, the agency is
1616 abolished September 1, 2019.
1717 SECTION 2. Subchapter B, Chapter 403, Government Code, is
1818 amended by adding Section 403.0146 to read as follows:
1919 Sec. 403.0146. REVIEW OF ACCURACY OF FISCAL NOTES. (a) The
2020 comptroller shall conduct a study for each fiscal biennium to
2121 determine the accuracy of fiscal notes prepared by the Legislative
2222 Budget Board and attached to bills or resolutions in accordance
2323 with Chapter 314 during the regular legislative session preceding
2424 the fiscal biennium. The study must compare the probable cost
2525 estimate contained in the fiscal notes with the actual cost to the
2626 state of the bills or resolutions.
2727 (b) Not later than December 1 of each even-numbered year,
2828 the comptroller shall publish a report containing the results of
2929 the study conducted under this section and any issues of concern or
3030 areas of improvement.
3131 (c) The comptroller shall adopt rules necessary to
3232 implement this section.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2017.
