| 9 | 9 | | the Legislative Budget Board. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 322, Government Code, is amended by |
|---|
| 12 | 12 | | adding Section 322.026 to read as follows: |
|---|
| 13 | 13 | | Sec. 322.026. SUNSET PROVISION. The Legislative Budget |
|---|
| 14 | 14 | | Board is subject to Chapter 325 (Texas Sunset Act). Unless |
|---|
| 15 | 15 | | continued in existence as provided by that chapter, the agency is |
|---|
| 16 | 16 | | abolished September 1, 2019. |
|---|
| 17 | 17 | | SECTION 2. Subchapter B, Chapter 403, Government Code, is |
|---|
| 18 | 18 | | amended by adding Section 403.0146 to read as follows: |
|---|
| 19 | 19 | | Sec. 403.0146. REVIEW OF ACCURACY OF FISCAL NOTES. (a) The |
|---|
| 20 | 20 | | comptroller shall conduct a study for each fiscal biennium to |
|---|
| 21 | 21 | | determine the accuracy of fiscal notes prepared by the Legislative |
|---|
| 22 | 22 | | Budget Board and attached to bills or resolutions in accordance |
|---|
| 23 | 23 | | with Chapter 314 during the regular legislative session preceding |
|---|
| 24 | 24 | | the fiscal biennium. The study must compare the probable cost |
|---|
| 25 | 25 | | estimate contained in the fiscal notes with the actual cost to the |
|---|
| 26 | 26 | | state of the bills or resolutions. |
|---|
| 27 | 27 | | (b) Not later than December 1 of each even-numbered year, |
|---|
| 28 | 28 | | the comptroller shall publish a report containing the results of |
|---|
| 29 | 29 | | the study conducted under this section and any issues of concern or |
|---|
| 30 | 30 | | areas of improvement. |
|---|
| 31 | 31 | | (c) The comptroller shall adopt rules necessary to |
|---|
| 32 | 32 | | implement this section. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2017. |
