| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 31.023(b), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (b) Each instructional material on the list must be: |
|---|
| 13 | 13 | | (1) free from factual errors; and |
|---|
| 14 | 14 | | (2) suitable for the subject and grade level for which |
|---|
| 15 | 15 | | the instructional material was submitted. |
|---|
| 16 | 16 | | SECTION 2. Section 31.035(a), Education Code, is amended to |
|---|
| 17 | 17 | | read as follows: |
|---|
| 18 | 18 | | (a) Notwithstanding any other provision of this subchapter, |
|---|
| 19 | 19 | | the State Board of Education may adopt supplemental instructional |
|---|
| 20 | 20 | | materials that are not on the list adopted under Section |
|---|
| 21 | 21 | | 31.023. The State Board of Education may adopt supplemental |
|---|
| 22 | 22 | | instructional material under this section only if the instructional |
|---|
| 23 | 23 | | material: |
|---|
| 24 | 24 | | (1) contains material covering one or more primary |
|---|
| 25 | 25 | | focal points or primary topics of a subject in the required |
|---|
| 26 | 26 | | curriculum under Section 28.002, as determined by the State Board |
|---|
| 27 | 27 | | of Education; |
|---|
| 28 | 28 | | (2) is not designed to serve as the sole instructional |
|---|
| 29 | 29 | | material for a full course; |
|---|
| 30 | 30 | | (3) meets applicable physical specifications adopted |
|---|
| 31 | 31 | | by the State Board of Education; [and] |
|---|
| 32 | 32 | | (4) is free from factual errors; and |
|---|
| 33 | 33 | | (5) is suitable for the subject and grade level. |
|---|
| 34 | 34 | | SECTION 3. Sections 31.023(b) and 31.035(a), Education |
|---|
| 35 | 35 | | Code, as amended by this Act, apply only to an instructional |
|---|
| 36 | 36 | | material list or supplemental instructional material adopted on or |
|---|
| 37 | 37 | | after the effective date of this Act. An instructional material |
|---|
| 38 | 38 | | list or supplemental instructional material adopted before the |
|---|
| 39 | 39 | | effective date of this Act is governed by the law in effect when the |
|---|
| 40 | 40 | | instructional material list or supplemental instructional material |
|---|
| 41 | 41 | | was adopted, and the former law is continued in effect for that |
|---|
| 42 | 42 | | purpose. |
|---|
| 43 | 43 | | SECTION 4. This Act takes effect September 1, 2017. |
