99 AN ACT
1010 relating to nonemergency medical transportation, shipping
1111 logistics, and coordination services for state agencies.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. The heading to Section 2172.007, Government
1414 Code, is amended to read as follows:
1515 Sec. 2172.007. NONEMERGENCY MEDICAL TRANSPORTATION,
1616 SHIPPING LOGISTICS, AND COORDINATION SERVICES.
1717 SECTION 2. Section 2172.007, Government Code, is amended by
1818 amending Subsections (a), (b), (c), and (d) and adding Subsections
1919 (f), (g), and (h) to read as follows:
2020 (a) The comptroller shall [may] contract with a vendor to
2121 oversee nonemergency medical transportation, shipping logistics,
2222 and coordination services for all state agencies and shall pay the
2323 contract from the anticipated cost savings realized under the
2424 contract. The vendor shall arrange the transportation or shipment
2525 of goods, parcels, and freight using the [shipping] company
2626 selected by the state agency through competitive bidding that
2727 provides the best value to the agency [for the shipment].
2828 (b) A state agency shall [may] arrange all transportation or
2929 shipments of goods, parcels, and freight under this section.
3030 (c) The vendor under this section shall maintain a record of
3131 each nonemergency medical transportation and other shipment
3232 arranged for a state agency, as applicable, including the cost of
3333 mileage for the nonemergency medical transportation, the cost of
3434 the transportation or shipment, the type of goods, parcels, or
3535 freight shipped, [and] the weight of the goods, parcels, or freight
3636 shipped, and any software licensing support used to meet the
3737 requirements of this section.
3838 (d) In contracting for the oversight of nonemergency
3939 medical transportation, shipping logistics, and coordination
4040 services under this section, the comptroller shall [may] provide
4141 contracting opportunities for vendors that employ veterans or other
4242 persons with disabilities whose products and services are available
4343 under Chapter 122, Human Resources Code.
4444 (f) Purchases of nonemergency medical transportation
4545 services under Section 2155.143, 2155.144, or 2155.1441 are subject
4646 to this section.
4747 (g) Not later than December 1, 2018, the comptroller shall
4848 evaluate the nonemergency medical transportation, shipping
4949 logistics, and coordination services under this section for not
5050 more than a 90-day period to determine:
5151 (1) the viability of contracting with a vendor to
5252 oversee these services;
5353 (2) the economic return on investment from contracting
5454 with a vendor to oversee these services; and
5555 (3) route efficiency and reasonableness.
5656 (h) Subsection (g) and this subsection expire September 1,
5757 2019.
5858 SECTION 3. Section 2172.007, Government Code, as amended by
5959 this Act, applies only to a contract entered into by the comptroller
6060 and a vendor to which that section applies on or after the effective
6161 date of this Act.
6262 SECTION 4. This Act takes effect immediately if it receives
6363 a vote of two-thirds of all the members elected to each house, as
6464 provided by Section 39, Article III, Texas Constitution. If this
6565 Act does not receive the vote necessary for immediate effect, this
6666 Act takes effect September 1, 2017.
