| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter E, Chapter 29, Education Code, is | |
| 11 | 11 | amended by adding Section 29.1535 to read as follows: | |
| 12 | 12 | Sec. 29.1535. STUDENT/TEACHER RATIOS. A school district | |
| 13 | 13 | that offers a prekindergarten program under Section 29.153 must | |
| 14 | 14 | maintain an average ratio of not less than one certified teacher or | |
| 15 | 15 | teacher's aide for each 10 students. | |
| 16 | 16 | SECTION 2. Section 29.167(d), Education Code, is amended to | |
| 17 | 17 | read as follows: | |
| 18 | 18 | (d) A school district must [attempt to] maintain an average | |
| 19 | 19 | ratio in any prekindergarten program class of not less than one | |
| 20 | 20 | certified teacher or teacher's aide for each 10 [11] students. | |
| 21 | 21 | SECTION 3. This Act applies beginning with the 2017-2018 | |
| 22 | 22 | school year. | |
| 23 | 23 | SECTION 4. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2017. |
