55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the disposition of certain state surplus or salvage
88 data processing equipment.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 2175.905(a), (b), and (c), Government
1111 Code, are amended to read as follows:
1212 (a) If a disposition of a state agency's surplus or salvage
1313 data processing equipment is not made under Section 2175.184, the
1414 state agency shall transfer the equipment to:
1515 (1) a school district or open-enrollment charter
1616 school in this state under Subchapter C, Chapter 32, Education
1717 Code;
1818 (2) an assistance organization specified by the school
1919 district; [or]
2020 (3) the Texas Department of Criminal Justice; or
2121 (4) Texas CASA for use in a foster home or foster group
2222 home.
2323 (b) If a disposition of the surplus or salvage data
2424 processing equipment of a state eleemosynary institution or an
2525 institution or agency of higher education is not made under other
2626 law, the institution or agency shall transfer the equipment to:
2727 (1) a school district or open-enrollment charter
2828 school in this state under Subchapter C, Chapter 32, Education
2929 Code;
3030 (2) an assistance organization specified by the school
3131 district; [or]
3232 (3) the Texas Department of Criminal Justice; or
3333 (4) Texas CASA for use in a foster home or foster group
3434 home.
3535 (c) The state eleemosynary institution or institution or
3636 agency of higher education or other state agency may not collect a
3737 fee or other reimbursement from the district, the school, the
3838 assistance organization, [or] the Texas Department of Criminal
3939 Justice, or Texas CASA for the surplus or salvage data processing
4040 equipment transferred under this section.
4141 SECTION 2. This Act takes effect September 1, 2017.
