11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter B, Chapter 54, Local Government Code, |
---|
13 | 13 | | is amended by adding Section 54.0155 to read as follows: |
---|
14 | 14 | | Sec. 54.0155. EXPEDITED PROCEEDINGS FOR CERTAIN CIVIL |
---|
15 | 15 | | ACTIONS. (a) A court shall expedite any proceeding, including an |
---|
16 | 16 | | appeal in accordance with Subsection (b), related to a suit brought |
---|
17 | 17 | | under this subchapter for the enforcement of an ordinance relating |
---|
18 | 18 | | to dangerously damaged or deteriorated structures or improvements |
---|
19 | 19 | | as described by Section 54.012(6). |
---|
20 | 20 | | (b) An appeal of a suit described by Subsection (a) is |
---|
21 | 21 | | governed by the procedures for accelerated appeals in civil cases |
---|
22 | 22 | | under the Texas Rules of Appellate Procedure. The appellate court |
---|
23 | 23 | | shall render its final order or judgment with the least possible |
---|
24 | 24 | | delay. |
---|
25 | 25 | | SECTION 2. Section 214.001, Local Government Code, is |
---|
26 | 26 | | amended by adding Subsection (s) to read as follows: |
---|
27 | 27 | | (s) A court shall expedite any proceeding, including an |
---|
28 | 28 | | appeal in accordance with Section 214.0012, related to a |
---|
29 | 29 | | substandard building determination under this section. |
---|
30 | 30 | | SECTION 3. Section 214.0012, Local Government Code, is |
---|
31 | 31 | | amended by adding Subsection (i) to read as follows: |
---|
32 | 32 | | (i) An appeal of a suit brought under Section 214.001 is |
---|
33 | 33 | | governed by the procedures for accelerated appeals in civil cases |
---|
34 | 34 | | under the Texas Rules of Appellate Procedure. The appellate court |
---|
35 | 35 | | shall render its final order or judgment with the least possible |
---|
36 | 36 | | delay. |
---|
37 | 37 | | SECTION 4. This Act takes effect immediately if it receives |
---|
38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
---|
39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
---|
41 | 41 | | Act takes effect September 1, 2017. |
