99 relating to expedited proceedings in cases involving substandard
1010 buildings or improvements.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 54, Local Government Code,
1313 is amended by adding Section 54.0155 to read as follows:
1414 Sec. 54.0155. EXPEDITED PROCEEDINGS FOR CERTAIN CIVIL
1515 ACTIONS. (a) A court shall expedite any proceeding, including an
1616 appeal in accordance with Subsection (b), related to a suit brought
1717 under this subchapter for the enforcement of an ordinance relating
1818 to dangerously damaged or deteriorated structures or improvements
1919 as described by Section 54.012(6).
2020 (b) An appeal of a suit described by Subsection (a) is
2121 governed by the procedures for accelerated appeals in civil cases
2222 under the Texas Rules of Appellate Procedure. The appellate court
2323 shall render its final order or judgment with the least possible
2424 delay.
2525 SECTION 2. Section 214.001, Local Government Code, is
2626 amended by adding Subsection (s) to read as follows:
2727 (s) A court shall expedite any proceeding, including an
2828 appeal in accordance with Section 214.0012, related to a
2929 substandard building determination under this section.
3030 SECTION 3. Section 214.0012, Local Government Code, is
3131 amended by adding Subsection (i) to read as follows:
3232 (i) An appeal of a suit brought under Section 214.001 is
3333 governed by the procedures for accelerated appeals in civil cases
3434 under the Texas Rules of Appellate Procedure. The appellate court
3535 shall render its final order or judgment with the least possible
3636 delay.
3737 SECTION 4. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2017.
