9 | 9 | | relating to a study on state agency digital data storage and records |

10 | 10 | | management practices and associated state costs. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. (a) In this section, "state agency" means a |
---|
13 | 13 | | board, commission, office, department, council, authority, or |
---|
14 | 14 | | other agency in the executive or judicial branch of state |
---|
15 | 15 | | government that is created by the constitution or a statute of this |
---|
16 | 16 | | state. The term does not include a university system or institution |
---|
17 | 17 | | of higher education as those terms are defined by Section 61.003, |
---|
18 | 18 | | Education Code. |
---|
19 | 19 | | (b) The Department of Information Resources, in |
---|
20 | 20 | | consultation with the Texas State Library and Archives Commission, |
---|
21 | 21 | | shall conduct a study on state agency digital data storage and |
---|
22 | 22 | | records management practices and the associated costs to this |
---|
23 | 23 | | state. |
---|
24 | 24 | | (c) The study required under this section must examine: |
---|
25 | 25 | | (1) the current digital data storage practices of |
---|
26 | 26 | | state agencies in this state; |
---|
27 | 27 | | (2) the costs associated with those digital data |
---|
28 | 28 | | storage practices; |
---|
29 | 29 | | (3) the digital records management and data |
---|
30 | 30 | | classification policies of state agencies and whether the state |
---|
31 | 31 | | agencies are consistently complying with the established policies; |
---|
32 | 32 | | (4) whether the state agencies are storing digital |
---|
33 | 33 | | data that exceeds established retention requirements and the cost |
---|
34 | 34 | | of that unnecessary storage; |
---|
35 | 35 | | (5) the adequacy of storage systems used by state |
---|
36 | 36 | | agencies to securely maintain confidential digital records; and |
---|
37 | 37 | | (6) possible solutions and improvements recommended |
---|
38 | 38 | | by the state agencies for reducing state costs and increasing |
---|
39 | 39 | | security for digital data storage and records management. |
---|
40 | 40 | | (d) Each state agency shall participate in the study |
---|
41 | 41 | | required by this section and provide appropriate assistance and |
---|
42 | 42 | | information to the Department of Information Resources and the |
---|
43 | 43 | | Texas State Library and Archives Commission. |
---|
44 | 44 | | (e) Not later than December 1, 2018, the Department of |
---|
45 | 45 | | Information Resources shall issue a report on the study required |
---|
46 | 46 | | under this section and recommendations for reducing state costs and |
---|
47 | 47 | | for improving efficiency in digital data storage and records |
---|
48 | 48 | | management to the lieutenant governor, the speaker of the house of |
---|
49 | 49 | | representatives, and the appropriate standing committees of the |
---|
50 | 50 | | house of representatives and the senate. |
---|
51 | 51 | | (f) This Act expires September 1, 2019. |
---|
52 | 52 | | SECTION 2. This Act takes effect September 1, 2017. |
