88 AN ACT
99 relating to a study on state agency digital data storage and records
1010 management practices and associated state costs.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. (a) In this section, "state agency" means a
1313 board, commission, office, department, council, authority, or
1414 other agency in the executive or judicial branch of state
1515 government that is created by the constitution or a statute of this
1616 state. The term does not include a university system or institution
1717 of higher education as those terms are defined by Section 61.003,
1818 Education Code.
1919 (b) The Department of Information Resources, in
2020 consultation with the Texas State Library and Archives Commission,
2121 shall conduct a study on state agency digital data storage and
2222 records management practices and the associated costs to this
2323 state.
2424 (c) The study required under this section must examine:
2525 (1) the current digital data storage practices of
2626 state agencies in this state;
2727 (2) the costs associated with those digital data
2828 storage practices;
2929 (3) the digital records management and data
3030 classification policies of state agencies and whether the state
3131 agencies are consistently complying with the established policies;
3232 (4) whether the state agencies are storing digital
3333 data that exceeds established retention requirements and the cost
3434 of that unnecessary storage;
3535 (5) the adequacy of storage systems used by state
3636 agencies to securely maintain confidential digital records; and
3737 (6) possible solutions and improvements recommended
3838 by the state agencies for reducing state costs and increasing
3939 security for digital data storage and records management.
4040 (d) Each state agency shall participate in the study
4141 required by this section and provide appropriate assistance and
4242 information to the Department of Information Resources and the
4343 Texas State Library and Archives Commission.
4444 (e) Not later than December 1, 2018, the Department of
4545 Information Resources shall issue a report on the study required
4646 under this section and recommendations for reducing state costs and
4747 for improving efficiency in digital data storage and records
4848 management to the lieutenant governor, the speaker of the house of
4949 representatives, and the appropriate standing committees of the
5050 house of representatives and the senate.
5151 (f) This Act expires September 1, 2019.
5252 SECTION 2. This Act takes effect September 1, 2017.
