9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 466.110, Government Code, is amended to | |
11 | 11 | read as follows: | |
12 | 12 | Sec. 466.110. PROHIBITED ADVERTISEMENTS. (a) The | |
13 | 13 | legislature intends that advertisements or promotions sponsored by | |
14 | 14 | the commission or the division for the lottery not be of a nature | |
15 | 15 | that unduly influences any person to purchase a lottery ticket or | |
16 | 16 | number. | |
17 | 17 | (b) The commission or a lottery operator may not advertise | |
18 | 18 | or promote the lottery in a county with a per capita income at or | |
19 | 19 | below 150 percent of the federal poverty level. | |
20 | 20 | (c) A sales agent operating in a county described by | |
21 | 21 | Subsection (b) may advertise or promote the lottery within the | |
22 | 22 | sales agent's place of business. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2017. |
