55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the notice given by a property owner prohibiting a
88 handgun license holder from carrying a handgun on certain property.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 411, Government Code, is
1111 amended by adding Section 411.2045 to read as follows:
1212 Sec. 411.2045. WRITTEN NOTICE: RULES. (a) The department
1313 shall adopt rules that prescribe the size of a sign and the
1414 lettering on that sign under Sections 30.06(c)(3)(B) and
1515 30.07(c)(3)(B), Penal Code. Rules adopted under this subsection
1616 may not require that a sign be larger than 8.5 inches by 11 inches
1717 for each language in which the sign must be posted.
1818 (b) The department by rule shall adopt a Spanish translation
1919 of the language required under Section 30.06(c)(3)(B) or
2020 30.07(c)(3)(B) for a sign described by Subsection (a).
2121 (c) The department shall make available on the department's
2222 Internet website a printable copy of the English and Spanish
2323 versions of a sign described by Subsection (a).
2424 SECTION 2. Section 30.06(c)(3), Penal Code, is amended to
2525 read as follows:
2626 (3) "Written communication" means:
2727 (A) a card or other document on which is written
2828 language identical to the following: "Pursuant to Section 30.06,
2929 Penal Code (trespass by license holder with a concealed handgun), a
3030 person licensed under Subchapter H, Chapter 411, Government Code
3131 (handgun licensing law), may not enter this property with a
3232 concealed handgun"; or
3333 (B) a sign posted on the property that:
3434 (i) includes the language described by
3535 Paragraph (A) in both English and Spanish;
3636 (ii) appears in contrasting colors with
3737 block letters and otherwise complies with the requirements
3838 regarding the size and lettering of the sign provided by rules
3939 adopted under Section 411.2045, Government Code [at least one inch
4040 in height]; and
4141 (iii) is displayed in a conspicuous manner
4242 clearly visible to the public.
4343 SECTION 3. Section 30.07(c)(3), Penal Code, is amended to
4444 read as follows:
4545 (3) "Written communication" means:
4646 (A) a card or other document on which is written
4747 language identical to the following: "Pursuant to Section 30.07,
4848 Penal Code (trespass by license holder with an openly carried
4949 handgun), a person licensed under Subchapter H, Chapter 411,
5050 Government Code (handgun licensing law), may not enter this
5151 property with a handgun that is carried openly"; or
5252 (B) a sign posted on the property that:
5353 (i) includes the language described by
5454 Paragraph (A) in both English and Spanish;
5555 (ii) appears in contrasting colors with
5656 block letters and otherwise complies with the requirements
5757 regarding the size and lettering of the sign provided by rules
5858 adopted under Section 411.2045, Government Code [at least one inch
5959 in height]; and
6060 (iii) is displayed in a conspicuous manner
6161 clearly visible to the public at each entrance to the property.
6262 SECTION 4. The public safety director of the Department of
6363 Public Safety shall adopt the rules described by Section 411.2045,
6464 Government Code, as added by this Act, and, not later than December
6565 1, 2017, make a printable electronic copy of the sign available on
6666 the department's Internet website as required by that section.
6767 SECTION 5. The change in law made by this Act applies only
6868 to an offense committed on or after January 1, 2018. An offense
6969 committed before January 1, 2018, is governed by the law in effect
7070 on the date the offense was committed, and the former law is
7171 continued in effect for that purpose. For purposes of this section,
7272 an offense was committed before January 1, 2018, if any element of
7373 the offense occurred before that date.
7474 SECTION 6. This Act takes effect September 1, 2017.
