1010 and releasing agencies.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Chapter 823, Health and Safety
1313 Code, is amended to read as follows:
1414 CHAPTER 823. ANIMAL SHELTERS AND RELEASING AGENCIES
1515 SECTION 2. Section 823.001, Health and Safety Code, is
1616 amended by adding Subdivision (5) to read as follows:
1717 (5) "Releasing agency" has the meaning assigned by
1818 Section 828.001.
1919 SECTION 3. Section 823.002, Health and Safety Code, is
2020 amended to read as follows:
2121 Sec. 823.002. EXEMPTION FOR CERTAIN COUNTIES, CLINICS, AND
2222 FACILITIES. Except as provided by Sections 823.003(e) and 823.010,
2323 this [This] chapter does not apply to:
2424 (1) a county having a population of less than 75,000;
2525 (2) a veterinary medicine clinic; or
2626 (3) a livestock commission facility.
2727 SECTION 4. Section 823.003(e), Health and Safety Code, is
2828 amended to read as follows:
2929 (e) The executive commissioner of the Health and Human
3030 Services Commission shall [may] require each person operating an
3131 animal shelter or releasing agency to keep records as required by
3232 Section 823.010. The executive commissioner may require the
3333 shelter or agency [of the date and disposition of animals in its
3434 custody,] to maintain the records on the business premises of the
3535 [animal] shelter or agency[,] and to make the records available for
3636 inspection at reasonable times.
3737 SECTION 5. Chapter 823, Health and Safety Code, is amended
3838 by adding Section 823.010 to read as follows:
3939 Sec. 823.010. INTAKE AND DISPOSITION RECORDS FOR ANIMAL
4040 SHELTERS AND RELEASING AGENCIES. (a) Each animal shelter,
4141 including a shelter operated by a municipality, or releasing agency
4242 operated in this state shall prepare and maintain records on the
4343 intake and disposition of animals in the care of the shelter or
4444 agency, including:
4545 (1) the total number of live animals taken in by the
4646 shelter or agency, categorized by:
4747 (A) species, as dog, cat, or other; and
4848 (B) age, as up to five months or adult;
4949 (2) the reason an animal was taken in by the shelter or
5050 agency, including whether the animal was:
5151 (A) surrendered by the animal's owner;
5252 (B) surrendered by the animal's owner and the
5353 owner requested that the animal be euthanized;
5454 (C) impounded as a stray animal or an animal at
5555 large;
5656 (D) confiscated;
5757 (E) transferred to the shelter or agency from a
5858 location in this state;
5959 (F) transferred to the shelter or agency from a
6060 location outside this state; or
6161 (G) born in the shelter or under the care of the
6262 agency;
6363 (3) the number of animals at the shelter or agency on
6464 the last day of each month, categorized by species, as dog, cat, or
6565 other, and age, as up to five months or adult; and
6666 (4) the disposition of each animal taken in by the
6767 shelter or agency, categorized by species, as dog, cat, or other,
6868 and age, as up to five months or adult, including whether the
6969 animal:
7070 (A) was adopted;
7171 (B) was reclaimed by the animal's owner;
7272 (C) died in the shelter or under the care of the
7373 agency;
7474 (D) was transferred from the shelter or agency;
7575 (E) was euthanized by the shelter or agency on a
7676 decision made by the shelter or agency;
7777 (F) was euthanized at the owner's request;
7878 (G) was returned to the field as part of a
7979 sterilization program; or
8080 (H) was lost or stolen while in the shelter's or
8181 agency's care.
8282 (b) An animal shelter or releasing agency shall monthly
8383 prepare the records required by Subsection (a).
8484 (c) An animal shelter or releasing agency shall maintain
8585 records prepared under Subsection (a) until at least the third
8686 anniversary of the date the record was prepared.
8787 (d) An animal shelter or releasing agency shall make the
8888 records required by this section available to the public by:
8989 (1) posting the records on the shelter's,
9090 municipality's, or agency's Internet website; or
9191 (2) for a shelter, municipality, or agency that does
9292 not have an Internet website, making the records available in a form
9393 regularly maintained by the shelter, municipality, or agency for
9494 inspection and copying.
9595 SECTION 6. The changes in law made by this Act apply only to
9696 an animal placed at or disposed of by an animal shelter or releasing
9797 agency or counted in the shelter's or agency's animal total on or
9898 after the effective date of this Act.
9999 SECTION 7. This Act takes effect September 1, 2017.
