55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to content requirements for an individualized education
88 program developed for a public school student with autism or
99 another pervasive developmental disorder.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 29.005(e), Education Code, is amended to
1212 read as follows:
1313 (e) The commissioner by rule shall, as provided by Section
1414 29.0052, [may] require a school district to include in the
1515 individualized education program of a student with autism or
1616 another pervasive developmental disorder any information or
1717 requirement determined necessary to ensure the student receives a
1818 free appropriate public education as required under the Individuals
1919 with Disabilities Education Act (20 U.S.C. Section 1400 et seq.).
2020 SECTION 2. Subchapter A, Chapter 29, Education Code, is
2121 amended by adding Section 29.0052 to read as follows:
2222 Sec. 29.0052. INDIVIDUALIZED EDUCATION PROGRAM FOR
2323 STUDENTS WITH AUTISM OR ANOTHER PERVASIVE DEVELOPMENTAL DISORDER.
2424 (a) In developing the individualized education program for a
2525 student with autism or another pervasive developmental disorder,
2626 the committee must include any interventions or services that the
2727 committee believes are appropriate to meet the educational needs of
2828 the student.
2929 (b) The committee shall consider feedback from a student's
3030 parent or guardian when determining interventions or services to be
3131 included in a student's individualized education program under this
3232 section.
3333 (c) If the committee does not include any interventions or
3434 services in the individualized education program for a student with
3535 autism or another pervasive developmental disorder, the committee
3636 must include a statement:
3737 (1) identifying each intervention or service that was
3838 considered for the student; and
3939 (2) explaining the reasoning behind the committee's
4040 determination not to include that intervention or service in the
4141 student's program.
4242 SECTION 3. This Act applies beginning with the 2017-2018
4343 school year.
4444 SECTION 4. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2017.
