10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 201.051, Insurance Code, is amended by | |
12 | 12 | adding Subsection (e) to read as follows: | |
13 | 13 | (e) Notwithstanding another provision of this section, the | |
14 | 14 | comptroller shall allocate premium or revenue with respect to | |
15 | 15 | premium tax imposed on an insurer or health maintenance | |
16 | 16 | organization under this title based solely on the premium or | |
17 | 17 | revenue allocation by state as reported by the insurer or health | |
18 | 18 | maintenance organization on the applicable form prescribed by the | |
19 | 19 | National Association of Insurance Commissioners and adopted by the | |
20 | 20 | commissioner by rule. | |
21 | 21 | SECTION 2. The change in law made by this Act does not | |
22 | 22 | affect tax liability accruing before the effective date of this | |
23 | 23 | Act. That liability continues in effect as if this Act had not been | |
24 | 24 | enacted, and the former law is continued in effect for the | |
25 | 25 | collection of taxes due and for civil and criminal enforcement of | |
26 | 26 | the liability for those taxes. | |
27 | 27 | SECTION 3. This Act takes effect January 1, 2018. |
