55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to public access to personal financial statements filed by
88 public officials and candidates.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 572.032, Government Code, is amended by
1111 amending Subsection (a) and adding Subsection (d) to read as
1212 follows:
1313 (a) Financial statements filed under this subchapter are
1414 public records. The commission shall maintain the statements in
1515 separate alphabetical files and in a manner that is accessible to
1616 the public during regular office hours and make the statements
1717 available to the public on the commission's website not later than
1818 the 15th day after the date the statement is required to be filed or
1919 is actually filed, whichever is later.
2020 (d) The commission is not required to continue to make
2121 available on its website a financial statement that may be
2222 destroyed under Subsection (c). The commission may not make
2323 available on its website a financial statement that the commission
2424 is required to destroy under Subsection (c).
2525 SECTION 2. Section 572.032(b), Government Code, is
2626 repealed.
2727 SECTION 3. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2017.
