| 14 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 8 | | SECTION 1. Section 49.184(e), Water Code, is amended to |
|---|
| 16 | 9 | | read as follows: |
|---|
| 17 | 10 | | (e) A contract or lease in which the proceeds of the |
|---|
| 18 | 11 | | contract or lease are pledged to the payment of a bond may be |
|---|
| 19 | 12 | | submitted to the attorney general along with the bond records, and, |
|---|
| 20 | 13 | | if submitted, the approval by the attorney general of the bonds |
|---|
| 21 | 14 | | shall constitute an approval of the contract or lease and the |
|---|
| 22 | 15 | | contract or lease shall be incontestable. A contract or lease, |
|---|
| 23 | 16 | | other than a contract or lease in which the proceeds of the contract |
|---|
| 24 | 17 | | or lease are pledged to the payment of a bond, may be submitted to |
|---|
| 25 | 18 | | the attorney general along with the bond records, and, if reviewed |
|---|
| 26 | 19 | | and approved by the attorney general, the approval of the bonds |
|---|
| 27 | 20 | | shall constitute an approval of the contract or lease and the |
|---|
| 28 | 21 | | contract or lease shall be incontestable. |

| 29 | 22 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 30 | 23 | | to a contract or lease submitted by a water district under Section |
|---|
| 31 | 24 | | 49.184, Water Code, as amended by this Act, to the attorney general |
|---|
| 32 | 25 | | after the effective date of this Act. A contract or lease submitted |
|---|
| 33 | 26 | | to the attorney general before the effective date of this Act is |
|---|
| 34 | 27 | | governed by the law in effect at the time the contract or lease is |
|---|
| 35 | 28 | | submitted, and that law is continued in effect for that purpose. |

| 36 | 29 | | SECTION 3. This Act takes effect September 1, 2017. |
