114 AN ACT
125 relating to the incontestability of certain contracts or leases
136 submitted to the attorney general by certain water districts.
147 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
158 SECTION 1. Section 49.184(e), Water Code, is amended to
169 read as follows:
1710 (e) A contract or lease in which the proceeds of the
1811 contract or lease are pledged to the payment of a bond may be
1912 submitted to the attorney general along with the bond records, and,
2013 if submitted, the approval by the attorney general of the bonds
2114 shall constitute an approval of the contract or lease and the
2215 contract or lease shall be incontestable. A contract or lease,
2316 other than a contract or lease in which the proceeds of the contract
2417 or lease are pledged to the payment of a bond, may be submitted to
2518 the attorney general along with the bond records, and, if reviewed
2619 and approved by the attorney general, the approval of the bonds
2720 shall constitute an approval of the contract or lease and the
2821 contract or lease shall be incontestable.
2922 SECTION 2. The change in law made by this Act applies only
3023 to a contract or lease submitted by a water district under Section
3124 49.184, Water Code, as amended by this Act, to the attorney general
3225 after the effective date of this Act. A contract or lease submitted
3326 to the attorney general before the effective date of this Act is
3427 governed by the law in effect at the time the contract or lease is
3528 submitted, and that law is continued in effect for that purpose.
3629 SECTION 3. This Act takes effect September 1, 2017.
