99 relating to the creation of an innocence project grant program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 79.039(a), Government Code, is amended
1212 to read as follows:
1313 (a) Each legal clinic or program in this state [that is
1414 operated by a law school and] that receives financial support from
1515 the commission shall submit to the commission an annual report
1616 regarding criminal cases:
1717 (1) in which the clinic or program has provided legal
1818 services to an indigent defendant during the preceding calendar
1919 year; and
2020 (2) in which:
2121 (A) based on a finding of actual innocence, the
2222 court of criminal appeals overturns a conviction; or
2323 (B) the governor issues a pardon based on actual
2424 innocence.
2525 SECTION 2. Subchapter C, Chapter 79, Government Code, is
2626 amended by adding Section 79.041 to read as follows:
2727 Sec. 79.041. INNOCENCE PROJECT GRANT PROGRAM. (a) Using
2828 any funds available for the purpose, the commission may establish
2929 an innocence project grant program to support:
3030 (1) projects that screen, investigate, and litigate
3131 post-conviction claims of actual innocence in non-capital cases in
3232 this state; and
3333 (2) associated expenses necessary to conduct those
3434 activities.
3535 (b) In making grant awards under the program, the commission
3636 shall promote among projects coordinated strategies that will
3737 enable those projects to efficiently screen requests for assistance
3838 and to engage in effective investigation and litigation activities.
3939 (c) Only a public or private law school in Texas is eligible
4040 to receive grants under the program.
4141 (d) A law school that receives a grant under Subsection (c)
4242 may enter into a contract with a nonprofit organization that is
4343 based in this state and operates an innocence project, provided
4444 that the law school accepts primary responsibility for monitoring
4545 the contract.
4646 (e) The commission may adopt rules to implement this
4747 section.
4848 SECTION 3. This Act takes effect September 1, 2017.
