| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 79.039(a), Government Code, is amended |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | (a) Each legal clinic or program in this state [that is |
|---|
| 14 | 14 | | operated by a law school and] that receives financial support from |
|---|
| 15 | 15 | | the commission shall submit to the commission an annual report |
|---|
| 16 | 16 | | regarding criminal cases: |
|---|
| 17 | 17 | | (1) in which the clinic or program has provided legal |
|---|
| 18 | 18 | | services to an indigent defendant during the preceding calendar |
|---|
| 19 | 19 | | year; and |
|---|
| 20 | 20 | | (2) in which: |
|---|
| 21 | 21 | | (A) based on a finding of actual innocence, the |
|---|
| 22 | 22 | | court of criminal appeals overturns a conviction; or |
|---|
| 23 | 23 | | (B) the governor issues a pardon based on actual |
|---|
| 24 | 24 | | innocence. |
|---|
| 25 | 25 | | SECTION 2. Subchapter C, Chapter 79, Government Code, is |
|---|
| 26 | 26 | | amended by adding Section 79.041 to read as follows: |
|---|
| 27 | 27 | | Sec. 79.041. INNOCENCE PROJECT GRANT PROGRAM. (a) Using |
|---|
| 28 | 28 | | any funds available for the purpose, the commission may establish |
|---|
| 29 | 29 | | an innocence project grant program to support: |
|---|
| 30 | 30 | | (1) projects that screen, investigate, and litigate |
|---|
| 31 | 31 | | post-conviction claims of actual innocence in non-capital cases in |
|---|
| 32 | 32 | | this state; and |
|---|
| 33 | 33 | | (2) associated expenses necessary to conduct those |
|---|
| 34 | 34 | | activities. |
|---|
| 35 | 35 | | (b) In making grant awards under the program, the commission |
|---|
| 36 | 36 | | shall promote among projects coordinated strategies that will |
|---|
| 37 | 37 | | enable those projects to efficiently screen requests for assistance |
|---|
| 38 | 38 | | and to engage in effective investigation and litigation activities. |
|---|
| 39 | 39 | | (c) Only a public or private law school in Texas is eligible |
|---|
| 40 | 40 | | to receive grants under the program. |
|---|
| 41 | 41 | | (d) A law school that receives a grant under Subsection (c) |
|---|
| 42 | 42 | | may enter into a contract with a nonprofit organization that is |
|---|
| 43 | 43 | | based in this state and operates an innocence project, provided |
|---|
| 44 | 44 | | that the law school accepts primary responsibility for monitoring |
|---|
| 45 | 45 | | the contract. |
|---|
| 46 | 46 | | (e) The commission may adopt rules to implement this |
|---|
| 47 | 47 | | section. |
|---|
| 48 | 48 | | SECTION 3. This Act takes effect September 1, 2017. |
