86 AN ACT
97 relating to the high school graduation of a student who transfers to
108 a public school in this state after the student's junior year of
119 high school.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Section 28.025, Education Code, is amended by
1412 adding Subsection (c-9) to read as follows:
1513 (c-9) Notwithstanding Subsection (c), a person may receive
1614 a diploma if the person is eligible for a diploma under Section
1715 28.02591.
1816 SECTION 2. Subchapter B, Chapter 28, Education Code, is
1917 amended by adding Section 28.02591 to read as follows:
2018 Sec. 28.02591. HIGH SCHOOL DIPLOMA AWARDED TO TRANSFER
2119 STUDENT ON BASIS OF INDIVIDUAL GRADUATION COMMITTEE REVIEW. (a)
2220 This section applies only to a student who:
2321 (1) transfers into the public school system of this
2422 state after completion of the student's 11th grade year in high
2523 school in a different state; and
2624 (2) will:
2725 (A) be unable, based on the credit awarded to the
2826 student by the public school system for coursework completed in a
2927 different state, to comply with the curriculum requirements of this
3028 state for high school graduation by the end of the student's 12th
3129 grade year; or
3230 (B) have difficulty complying with the
3331 end-of-course assessment instrument requirements for high school
3432 graduation imposed under Section 39.025.
3533 (b) For each student to whom this section applies, the
3634 school district that the student attends shall establish an
3735 individual graduation committee at the beginning of the student's
3836 12th grade year to determine whether the student may qualify to
3937 graduate as provided by this section. A student may not qualify to
4038 graduate under this section before the student's 12th grade year.
4139 The committee shall be composed of:
4240 (1) the principal or principal's designee;
4341 (2) the department chair or lead teacher for each
4442 subject for which an end-of-course assessment instrument is
4543 administered under Section 39.023(c); and
4644 (3) the student's parent or person standing in
4745 parental relation to the student or the student, if the student is
4846 at least 18 years of age.
4947 (c) The superintendent of each school district shall
5048 establish procedures for the convening of an individual graduation
5149 committee under this section.
5250 (d) In determining whether a student for whom an individual
5351 graduation committee is established is qualified to graduate, the
5452 committee shall consider:
5553 (1) the recommendation of the student's teacher in
5654 each course for which the student was not administered an
5755 end-of-course assessment instrument;
5856 (2) the student's performance on each:
5957 (A) alternative nationally recognized
6058 norm-referenced assessment instrument that the student requests to
6159 be considered; or
6260 (B) Texas Success Initiative (TSI) assessment
6361 instrument that the student requests to be considered;
6462 (3) the student's overall preparedness for
6563 postsecondary success; and
6664 (4) any other academic information designated for
6765 consideration by the board of trustees of the school district.
6866 (e) After considering the criteria under Subsection (d),
6967 the individual graduation committee may determine that the student
7068 is qualified to graduate. The commissioner by rule shall establish
7169 a timeline for making a determination under this subsection. The
7270 decision of a committee is final and may not be appealed.
7371 (f) The commissioner shall adopt rules as necessary to
7472 implement this section.
7573 SECTION 3. Section 39.025, Education Code, is amended by
7674 adding Subsections (h) and (i) to read as follows:
7775 (h) Notwithstanding any other provision of this section,
7876 the commissioner shall allow a student to satisfy the requirements
7977 of Subsection (a) and qualify for a high school diploma through
8078 satisfactory performance on one or more alternative nationally
8179 recognized norm-referenced assessment instruments or Texas Success
8280 Initiative (TSI) assessment instruments if the student transfers
8381 into the public school system of this state after completion of the
8482 student's 11th grade year in high school in a different state and
8583 the student receives a recommendation by the student's individual
8684 graduation committee under Section 28.02591 that the student
8785 qualifies for a high school diploma.
8886 (i) For purposes of Subsection (h), the commissioner, in
8987 order to ensure that a student described by that subsection may
9088 satisfy the requirements of Subsection (a) solely through
9189 performance on one or more alternative nationally recognized
9290 norm-referenced assessment instruments or Texas Success Initiative
9391 (TSI) assessment instruments, shall establish required performance
9492 levels for the assessment instruments that correspond to the
9593 performance levels otherwise required under Subsection (a) on the
9694 secondary exit-level assessment instruments for English language
9795 arts, mathematics, social studies, and science.
9896 SECTION 4. Section 28.02591, Education Code, as added by
9997 this Act, and Section 39.025, Education Code, as amended by this
10098 Act, apply beginning with students enrolled in public high schools
10199 in this state as a senior during the 2017-2018 school year.
102100 SECTION 5. This Act takes effect immediately if it receives
103101 a vote of two-thirds of all the members elected to each house, as
104102 provided by Section 39, Article III, Texas Constitution. If this
105103 Act does not receive the vote necessary for immediate effect, this
106104 Act takes effect September 1, 2017.
